dc.description.abstractLa prescripción en el proceso de Responsabilidad Fiscal en Colombia es un fenómeno jurídico de gran relevancia que afecta la capacidad del Estado para sancionar actos de gestión fiscal irregular. La prescripción se refiere al período de tiempo después del cual una acción legal ya no puede ser perseguida. En el contexto de la Responsabilidad Fiscal, esto implica que, si no se inicia un proceso sancionatorio dentro de un plazo determinado, los presuntos responsables quedan exentos de cualquier sanción. Esta limitación temporal busca equilibrar la necesidad de sancionar la mala gestión de los recursos públicos con la protección de los derechos de los investigados. Es importante destacar que la prescripción no es un obstáculo absoluto, ya que existen excepciones y situaciones que pueden suspender o interrumpir el plazo de prescripción. Por ejemplo, si se descubre nueva evidencia o si los presuntos responsables intentan ocultar información relevante, el plazo puede reiniciarse. En síntesis, su aplicación busca garantizar la justicia y la eficiencia en la gestión de los recursos públicos.

The statute of limitations refers to the period of time after which a legal action can no longer be pursued. In the context of Fiscal Responsibility, this implies that, if a sanctioning process is not initiated within a certain period, the alleged perpetrators are exempt from any sanction. This time limitation seeks to balance the need to punish the mismanagement of public resources with the protection of the rights of those investigated. It is important to highlight that prescription is not an absolute obstacle, since there are exceptions and situations that can suspend or interrupt the limitation period. For example, if new evidence is discovered or if the alleged perpetrators attempt to conceal relevant information, the deadline may be reset. In summary, its application seeks to guarantee justice and efficiency in the management of public resources.
