| dc.description | This essay argues that the serious situation of overcrowding, uprooting, loss of identity and cultural integrity of indigenous people in prison requires emphasizing intercultural measures that guarantee the application of ethnic and cultural diversity principle. To develop this idea, the first section shows the neglect of indigenous people in prison and the problems of multicultural jurisprudence that claims to protect them (I). The second section argues that an intercultural perspective has more advantages than a multicultural perspective to overcome the serious situation of indigenous people in prison and to implement at least two indigenous proposals: intercultural prison indigenous treatment and harmonization centers or their equivalents according to the worldview of each people (II). The third section draws attention to the advantages of intercultural dialogue and presents, based on the participant observation of the authors, a balance of the prior consultation process of the legal instrument that seeks to regulate the conditions of indigenous people deprived of liberty in prison (III). | en-US |
| dc.description | Este ensayo argumenta que la grave situación de hacinamiento, desarraigo, pérdida de la identidad e integridad culturales de los indígenas en prisión, requiere enfatizar medidas interculturales que garanticen la aplicación del principio constitucional de diversidad étnica y cultural. Para desarrollar esta idea, la primera sección evidencia la desatención de los indígenas en la cárcel y los problemas de la jurisprudencia multicultural que afirma protegerlos (I). La segunda sección sostiene que una perspectiva intercultural tiene más ventajas que una perspectiva multicultural para superar la grave situación de los indígenas en prisión y poner en marcha al menos dos propuestas indígenas: el tratamiento penitenciario propio intercultural y los centros de armonización o sus equivalentes según la cosmovisión de cada pueblo (II). La tercera llama la atención sobre las ventajas del diálogo intercultural y presenta, a partir de la observación participante de los autores, un balance del proceso de consulta previa del instrumento jurídico que pretende regular las condiciones de los indígenas privados de la libertad en establecimientos carcelarios del Estado (III). | es-ES |
