Publicación: Justice in the Province of Buenos Aires: the stripping away of legal powers, reforms and tensions in a scenario of political transition (1914-1922)

| dc.description | In 1918 the Province of Buenos Aires began to transit its first democratic experience with the political triumph of the Radical Civic Union (UCR) in the gubernatorial elections. When in the opposition, this political party had pointed out that one of the main problems was the undue political interference of politics in the justice system. Therefore, it had promised that in case of reach office, it would guarantee greater transparency in the judicial administration. This work focuses on the years before and after the arrival of the UCR to the government in order to analyze whether the changes in the political cast resulted in more willingness to project, design and implement legislative reforms to strengthen judicial independence. This subject has not been addressed by historiography. The article examine the legislative project that gave back to the Justice the power to appoint auxiliary judicial personnel and analyzes the tensions that it raised in order to elucidate to what extent old political practices interfered in implementing judicial reforms. It also considers the position assumed by the Supreme Court to recover a power taken away from the tribunal. | en-US |
| dc.description | En 1918 la provincia de Buenos Aires comenzaba a transitar su primera experiencia democrática con el triunfo electoral de la Unión Cívica Radical (UCR) a la gobernación. Uno de los principales problemas que este partido político había señalado desde la oposición fue la injerencia indebida de la política en la justicia, por lo que prometió garantizar mayor transparencia en su funcionamiento de acceder al gobierno. Este trabajo se centra en los años previos y posteriores al triunfo de la UCR con el objetivo principal de analizar si la renovación que experimentó el elenco político se tradujo en mayor voluntad para proyectar, diseñar e implementar reformas a fin de fortalecer la independencia judicial, aspecto que no ha merecido atención por parte de la historiografía. En particular, detiene la mirada en el proyecto legislativo que devolvía al Poder Judicial la atribución de designar el personal auxiliar, analiza las tensiones que suscitó a fin de ilustrar hasta qué punto viejas prácticas políticas se interpusieron en implementar reformas en la materia. En este contexto, la posición que asumió la Suprema Corte para recuperar una potestad arrebatada también será objeto de atención. | es-ES |
