dc.description.abstractEl Desplazamiento Forzado en Colombia ha producido una gran cantidad de Acciones de Tutela a analizar, en pro de lograr de la eficacia del Estado Social de Derecho. Parte de esta problemática, nace de la falta de recursos tanto humanos como económicos que hagan frente al fenómeno; en este sentido, la Filosofía del Derecho aporta valiosas teorías que permiten entender la necesidad de interpretar la ley de acuerdo a una buena hermenéutica, y acorde a la necesidad primaria de la victima, esto es, sin necesidad de acudir a la Acción Judicial cuando la Administración conoce de sus obligaciones. Buenas intenciones tendría el constituyente al implantar nuestra forma de Estado, adoptando filosofías foráneas que antecedieron a una globalización que incluye el cumplimiento de normas internacionales en el tema de los Derechos Humanos; no obstante lo anterior, hay óbices económicos que impiden la aplicación de un Estado de Bienestar propio de países con excedentes económicos. Por último, y como eje central del escrito, se realiza un corto análisis del trasegar jurisprudencial de los Desplazados, quienes se han visto en la necesidad de transitar un camino que ha implicado marcar los lineamientos de la Administración en su función de cumplir y hacer cumplir la Constitución y los derechos fundamentales de los colombianos.
dc.description.abstractenglishThe Colombia™s Internal Forced Displacement had produced a lot of Action for tutela to analyze, seeking for efficiency of Social State of Right. Part of this issue, comes from the lack of both, human and economical resources which face such phenomenon; in than sense, Philosophy of Right gives valuable theories that allow to understand the need to interpret the law along of good hermeneutic, according to the basic victim™s need, it means, without the demand to come up to the Justice when the Administration civil service knows its commitments. When the constituent assembly introduces that new kind of State maybe had good intentions, adopting foreign philosophies which came before of Globalization that includes compliance of international laws related to Human Rights, nevertheless, there are obstacles which prevent the implementation of Welfare State from wealthy countries. The last, but not the least central subject of this article, has to do with a short of analysis about the movement of displaced because of the violence Constitutional Court Ruling, whose had made itself the way to shows off the guidelines to the government in its duty to fulfill and make, both the Constitution and the basic rights of the Colombian people to happen
