"No estamos aquí de paso para pisotear las rosas ni marchitar su aliento de aromas sagrados con nuestra razonable epilepsia inquisidora porque la tierra reverdecerá sin nosotros pero nosotros sin ella no viviremos un instante". Gonzalo Arango Resumen Por sus implicaciones en la vida de los habitantes del planeta tierra y por su inclusión en la legislación nacional e internacional, la protección del ambiente como un derecho humano, constituye un tema de actualidad y de obligada discusión académica desde una perspectiva holística, en las circunstancias actuales de desequilibrio ecológico. Este ensayo aborda la problemática, cuestionando las relaciones de soberanía establecidas entre el ser humano con la naturaleza y enfatiza en la necesidad de establecer un nuevo contrato social sobre bases éticas y solidarias. Para ello se analizan distintos instrumentos jurídicos a nivel internacional como la Declaración de Estocolmo, la Conferencia sobre Medio Ambiente y Desarrollo de Río de Janeiro, en tanto que a nivel nacional se hace referencia a la Constitución Política de 1991, el Código de Recursos Naturales y la Ley 99 de 1993 en los aspectos pertinentes a la temática ambiental.
Summary For their implications in the life of the peoples of the planet earth and for their inclusion in the national and intemational legislation, the protection of the environment like a human right, it constitutes a topic of present time and of having forced academic discussion from a holistic perspective, in the current circumstances of ecological imbalance. This essay, approaches the problem, questioning the established relationships of sovereignty among the human being with the nature and it emphasizes in the necessity of establishing a new social contract on ethical and solidary bases. For they are analyzed it different juridical instruments at international level as the Declaration of Estocolmo, the Conference of the Environment and Development of Río de Janeiro, as long as at national level reference is made to Political Constitution of 1991, the Code of Natural Resources and the Law 99 of 1993 in the pertinent aspects to the thematic one environmental.
