La deontología notarial desde la teoría de los principios de Robert Alexi : ¿valores, principios o reglas?

dc.description.abstractEl propósito fundamental del presente escrito es determinar, a partir de la teoría de los principios de Robert Alexi, sí la deontología que rige la función notarial es un sistema compuesto por valores, por principios o por reglas: filos primeros suponen la base general sobre la cual se concretarán los principios y después las normas (reglas). Para lograr el objetivo, después de establecer que la deontología notarial es la ciencia del deber y es la que entra a detallar los deberes notariales más importantes; en forma sucinta, es la ciencia que describe cual es la evolución que ha experimentado la teoría de los principios en la historia. Luego se reconstruye conceptualmente la teoría de los principios de Robert Alexi en cuanto a la distinción que él realiza, pues, por un lado, en torno a reglas y principios; vistos éstos como fimandatos de optimización que dependen de lo fáctico y lo jurídico y, por el otro en cuanto a la distinción entre principios y valores desde la tríada conceptual que establece Von Wright; por último, la deontología notarial es revisada desde éstos contenidos.
dc.description.abstractenglishThe fundamental intention of the present writing is to determine, from the theory of the principles of Robert Alexi, yes the deontology that governs the notarial function is a system made up by values, principles or rules: fifirst they suppose the general base on which the principles will take shape later and the norms (rules). In order to achieve the objective, after establishing that notarial deontology is the science of having and is the one that enters to detail the more important notarial duties; in brief form, it is the science that it describes what is the evolution that has undergone the theory of the principles in history. Soon the theory of the principles of Robert Alexi as far as the distinction is reconstructed conceptually that it realises, then, on the one hand, around rules and principles; sights these like fioptimization mandates that depend on factual and the legal thing and, on the other as far as the distinction between principles and values from the conceptual tríada one that establishes Bon Wright; finally, notarial deontology is reviewed from these contents.
