dc.description.abstractLa presente investigación intenta contribuir al estudio del delito de homicidio como forma de manifestación del conflicto social en la ciudad de Bucaramanga en un periodo convulso de la historia de Colombia. En un primer momento estudia la causalidad del delito de homicidio y su aplicación penal en la ciudad durante el periodo comprendido entre 1946 a 1956, periodo en el cual tienen lugar hechos coyunturales que marcaron la historia social y política de Colombia. Desde esta perspectiva, se busca establecer que tan notable fue la incidencia del bipartidismo y de la violencia generada por éste, en los índices de criminalidad para la ciudad de Bucaramanga en el mencionado periodo de estudio, atendiendo factores de tipo social como aquellos que conforman la denominada mala vidafl y que condujeron inevitablemente a que se suscitaran homicidios. Se realizó un estudio sobre los crímenes cometidos contra la persona, a partir del estudio de los homicidios, mediante el análisis detallado de los expedientes judiciales, existente en el Fondo de Juicios Criminales del Archivo Judicial Superior del Circuito de Bucaramanga. La intención es establecer las pautas de la violencia interpersonal en la sociedad de aquella época. Por ello fue necesario determinar las características de los agresores, de las víctimas y los motivos que tuvieron para infringir la ley y cometer tales hechos de violencia. También se estudiaron las pautas espaciales y temporales de los homicidios, así como las armas utilizadas. Además, se hizo énfasis en los tipos de penas con las que se castigaron a los agresores y las consideraciones que se tuvieron en cuenta al establecerlas o imponerlas.
dc.description.abstractenglishThe present investigation tries to contribute to the study of the homicide crime like form of manifestation of the social conflict in the city of Bucaramanga in one period convulse of the history of Colombia. In a first moment he/she studies the causation of the homicide crime and their penal application in the city during the period understood among 1946 at 1956, period in which they take made place of the situation that the social history and politics of Colombia marked. From this perspective, it is looked for to settle down that so remarkable it was the incidence of the bipartisanship and of the violence generated by this, in the indexes of crime rate for the city of Bucaramanga in the mentioned period of study, assisting factors of social type as those that conform the one denominated "bad life" and that they drove inevitably to that homicides were raised. It was carried out a study on the crimes made against the person, starting from the study of the homicides, by means of the detailed analysis of the judicial files, existent in the Fund of Criminal Trials of the File Judicial Superior of the Circuit of Bucaramanga. The intention is to establish the rules of the interpersonal violence in the society of that time. For it was necessary to determine the characteristics of the aggressors, of the victims and the reasons that had to infringe the law and to make such facts of violence. The space rules and storms of the homicides were also studied, as well as the used weapons. Also, emphasis was made in the types of hardships with those that were punished to the aggressors and the considerations that were kept in mind when establishing them or to impose them.
