dc.description.abstractEste trabajo, constituye una reflexión sobre el tema del castigo, sin que emerja como una solución a los problemas que sobre éste, actualmente, nos aquejan; sólo se muestra como era la idea del castigo desde cuando éste se originaba en la inspiración divina, para pasar al derecho natural y posteriormente a las leyes anteriores a la existencia misma del estado. Es así, como a partir de la lectura de la obra prehispánica fiLa Leyenda de Yurupary, pretendo hacer un análisis sobre dicho tema, basándome en el libro que escribió Enrique Eduardo Mari, denominada fiLa Problemática del Castigo, a través del cual se estudiarán las diferentes teorías que lo definen, las clases de castigos de que trata el mito y el fin perseguido, para determinar en que teoría se ubican. Por otro lado, hay que resaltar, que al analizar la obra mitológica, podemos advertir que las distintas clases de castigos a que ella hace referencia, no se ubican en particular en una corriente filosófica exclusiva, sino que comparten características de ambas corrientes, lo que sucede actualmente, en donde resulta difícil encuadrar en un solo pensamiento filosófico, los fines de la pena, por lo cual, tenemos que remitirnos a las diferentes escuelas que estudian el tema y tomar lo mejor de cada una de ellas, para aplicar la ley a los infractores, teniendo en cuenta la clase de delito a investigar y el daño que haya causado tanto a la víctima como a la sociedad en sí misma.
dc.description.abstractenglishThis essay is about a close observation of punishment, without this to emerge as the answer to the problems of itself that are still around us nowadays. This document shows an idea of how the punishment was seen and how it originated from a divine inspiration; becoming a natural law and subsequently as a previous law until the existence of the state by itself. And this is how, from the pre-Hispanic text called "La Leyenda de Yurupari" The legend of Yurupari. This analysis is based on the book "La Problematica del Castigo" The Punishment problematic written by Enrique Eduardo Mari, through which I intent to study the different theories that define it, the kind of punishments that this myth talks about and its purpose, to be able to determine in which theory they could be placed. In the other hand, it is important to highlight, that when we analyze this mythological text, we could infer that the different kinds of punishment can not be placed in a particular philosophical current; but, they share characteristics of both currents. Today, it's very difficult to position punishment in a single philosophical thought; that's why, we have to go back to the various schools that study the subject and take the best from each one of them. Only this way, we can enforce the law by having in mind the kind of offense to be investigated and the damaged caused to victim as well as to the society itself.
