| dc.description.abstract | Se realizó la investigación haciendo un seguimiento de los diferentes instrumentos jurídicos internacionales que dan protección especial a los ecosistemas de alta montaña y analizando el desarrollo normativo y aplicación que se ha dado de estos instrumentos en Colombia para el Parque Nacional Natural de la Sierra Nevada del Cocuy. Como objetivo principal del trabajo de grado se planteó la generación de conciencia ambiental en la comunidad sobre la necesidad e importancia de proteger y dar un adecuado manejo a la biodiversidad que albergan los ecosistemas de alta montaña. En el mismo proceso investigativo se estudiaron los elementos que caracterizan el Derecho Internacional Ambiental y la manera en que la organización de las Naciones Unidas (ONU) influye en la creación y adopción de instrumentos jurídicos que se dirigen a la protección del medio ambiente dentro del marco de criterios de desarrollo sostenible. Se concluyo como problema jurídico planteado en la investigación, la manera en que finalmente una norma blanda, como lo es la Agenda 21, logra influir en el ordenamiento jurídico nacional y generar instrumentos jurídicos de carácter vinculante orientados a cumplir con los principios de protección y conservación medioambiental a nivel mundial. El documento final se constituye como un aporte a la comunidad académica, por presentar una estructura organizada de los diferentes instrumentos jurídicos que caracterizan el denominado derecho de montañafl, partiendo desde su origen en el orden internacional resultado de acuerdos logrados en las conferencias de la Organización de las Naciones Unidas, pasando luego por la sub-región andina y finalmente llegando a incidir en el ordenamiento nacional de Colombia. | |
| dc.description.abstractenglish | The investigation was realized making a pursuit of the different international juridical instruments that confers a special protection to the high mountain ecosystems and analyzing the normative development and application that had been delivered to these instruments in Colombia for the Natural National Park of Sierra Nevada of Cocuy. As a main objective of the work for graduation, it was traced the generation of environment consciousness in the community about the importance and the necessity of protect and give a righteous management to the biodiversity that take place in the high mountain ecosystems. In the same investigational process, it was studied the elements that characterize the Environmental International Laws and the manner of the United Nations (UN), influence in the creation and adoption of juridical instruments that conducts to the protection of the environment inside the frame of sustainable development criterions. It was conclude as a juridical problem traced in the investigation, the manner in which finally a soft law, as it is the Agenda 21, obtain influence in the national juridical arrangement and generate juridical instruments with an entailment characteristic orientated to accomplishment with the principles of environmental protection and conservation in the worldwide level. The final document constituted as a contribution to the academic community, for showing an organized structure of the different juridical instruments that characterizes the denominate Mountain related Legislationfl. It starts from their origin in the international order, product of the agreements accomplished in the conferences of the United Nations, then passing throw by the Andean subregion and finally arriving to meet with the Colombian national arrangement. 2 Work for graduation | |
