dc.description.abstract	En Colombia la Agencia de Retención es una figura jurídica, creada por la ley, que cobija e involucra no solo a personas jurídicas, sino a personas naturales. Las funciones que cumple el agente retenedor son de vital importancia para el funcionamiento mismo del Estado, toda vez que participa en la tarea de recaudar tributos que, posteriormente, pasan a ser parte del Fisco. Sin embargo, la mayoría de las veces, la sociedad, y quienes cumplen deberes de agentes retenedores, desconocen el exhaustivo régimen de responsabilidad al que se encuentran sometidos. Ante el eventual incumplimiento o retraso en el cumplimiento de sus deberes, el agente retenedor no solo se podría encontrar inmerso en investigaciones de carácter penal, sino también, proponemos, en investigaciones de carácter disciplinario.
dc.description.abstractenglish	In Colombia the withholding agency is a legal figure, created by law, which covers and involves not only legal entities, but also natural persons. The functions performed by the withholding agent are of vital importance for the operation of the State itself, since it collaborates in the task of collecting taxes that subsequently become part of the treasury. However, most of the time, society and those who fulfill the duties of withholding agents are unaware of the exhaustive liability regime to which they are subject. In the event of noncompliance or delay in the fulfillment of his duties, the withholding agent could not only find himself immersed in criminal investigations, but also, we propose, in disciplinary investigations
