dc.description.abstract	¿Por qué debemos apelar a un concepto como el de justicia para referirnos a las desigualdades en salud?, ¿Por qué no hablar solamente de igualdad en salud? Por otra parte ¿Cuál es el sentido de estudiar el sistema de salud en Colombia a partir de la Constitución de 1991? ¿Es el sistema de salud en Colombia un absoluto fracaso? O por el contrario ¿es uno de los mejores del mundo? En la medida de lo posible esta investigación trata de dar respuesta a las anteriores preguntas, en un tema que ha ocupado en los últimos años un importante lugar en la opinión pública. La novedad de este trabajo se halla en que supera dos cuestiones sobre las que por lo general ha girado el debate en salud: 1) el análisis ceñido al estudio de la estructura institucional y 2) el enfrentamiento entre eficiencia y equidad. Sin desdeñar estos elementos, la investigación adopta una perspectiva conceptual y teórica que busca integrarlos a la discusión mostrando su interdependencia. La comprensión de la justicia en Amartya Sen, más que buscar en los esquemas institucionales, se interesa por las realizaciones sociales. En este sentido este trabajo indaga por los resultados y las disparidades regionales en variables mortalidad en la niñez y mortalidad materna; las cuales tienen el carácter de evitables con uso racional de recursos. Por lo cual sirven para centrar la atención en aspectos de justicia regional del sistema de salud luego de cerca de dos décadas de vigencia. Asimismo la investigación centra la atención en la conjunción de instrumentos contemplados en la Constitución de 1991, como la acción de tutela, y las posibles consecuencias que estos requerimientos de justicia puede tener en el sistema de salud y los procesos de inclusión social en el país.
dc.description.abstractenglish	Why must we appeal to a concept as that of justice to refer to the desigualdades in health?, why not to speak only about equality in health? On the other hand which is the sense of studying the system of health in Colombia from the Constitution of 1991? Is it the system of health in Colombia an absolute failure? Or on the contrary is he one of the best of the world? As far as possible this investigation tries to give response to the previous questions, in a topic that has occupied in the last years an important place in the public opinion. The innovation of this work is situated in that it overcomes two questions on which in general it has turned the debate in health: 1) the analysis encircled to the study of the institutional structure and 2) the conflict between efficiency and equity. Without disdaining these elements, the investigation adopts a conceptual and theoretical perspective that seeks to integrate them to the discussion showing his interdependence. The comprehension of the justice in Amartya Sen, more that to search in the institutional schemes, is interested for the social achievements. In this respect this work investigates for the results and the regional disparities in variable mortality in the childhood and mother mortality; which have the character of avoidable with rational use of resources. For which they serve to centre the attention on aspects of regional justice of the system of health after near two decades of force. Likewise the investigation centres the attention on the conjunction of instruments contemplated in the Constitution of 1991, as the action of guardianship, and the possible consequences that it can have these requirements of justice in the system of health and the processes of social incorporation in the country.
