dc.description.abstract	El presente trabajo de investigación, parte del reconocimiento y respeto de las personas en condición de discapacidad, su autonomía y libre decisión respecto de sus derechos sexuales y reproductivos, por lo tanto, se indaga históricamente la vulneración de los derechos hacia esta comunidad, desde la edad primitiva, hasta la edad moderna, posteriormente se analiza el ordenamiento internacional y nacional existente que protege estos derechos, enfatizando la ley 1346 de 2009 que es aquella que ratifica la Convención Internacional sobre los derechos de las personas con discapacidad, esto para poder abordar por medio del análisis de la jurisprudencia de la Corte Constitucional de Colombia, las sentencias y los criterios que se han desarrollado antes y después de la promulgación de dicha ley, en decisiones que tengan que ver sobre los derechos sexuales y reproductivos de las personas en condición de discapacidad mental. Para establecer en qué medida han incidido los principios internacionales, en la evolución de los criterios de la Corte y cuál de estos criterios tiene vigencia en la actualidad, finalmente se hará un estudio acerca del proyecto de ley 027 de 2017 por medio del cual se establece el régimen para el ejercicio de la capacidad legal de las personas con discapacidad mayores de edad, esto para hacer énfasis en la incidencia de la ley 1346 del 2009 y como la corte constitucional marcó una diferencia para esta población vulnerable.
dc.description.abstractenglish	The present investigation, part of the recognition and respect of people with disabilities, their autonomy and free decision regarding their sexual and reproductive rights, therefore, has been historically investigated the violation of the rights to this community, from the modern age, and the existing national and international law that protects these rights, emphasizing Law 1346 of 2009 which is the one that ratifies the International Convention on the rights of persons with disabilities, this to be able to address through the analysis of the jurisprudence of the Constitutional Court of Colombia, the judgments and the criteria that have been developed before and after the promulgation of said law, in decisions that have to do with the sexual and reproductive rights of people with mental disability. To establish the extent to which international principles have influenced the evolution of the Court's criteria and which of these criteria is currently valid, finally a study will be made about the project of law 027 of 2017 by means of which the regime is established for the exercise of the legal capacity of the persons with disabilities of legal age, this to make emphasis in the incidence of the law 1346 of the 2009 and how the constitutional court made a difference for this vulnerable population.
