| dc.description.abstract | Este trabajo expone claramente la problemática penitenciaria que afecta a la sociedad colombiana debido a que no hay una política criminal conforme que garantice el respeto por los derechos humanos dentro de las prisiones y contrarreste los constantes brotes de violencia en la sociedad y en las prisiones. Se ha promovido por parte del gobierno nacional la creación de nuevos establecimientos penitenciarios tratando de cortar institucionalmente la violencia organizada dentro de los centros de reclusión, estableciendo prioridad en la seguridad al interior de los centros sobre las garantías y derechos fundamentales de las personas privadas de la libertad, observándose que a todas luces ha quedado estancada la evolución de la resocialización al interior de los centros de reclusión. Para comprobar esta hipótesis se observa el régimen de visitas en el Establecimiento Penitenciario de Alta y Mediana Seguridad de Girón la cual pertenece a la nueva cultura penitenciaria en donde se observa la realidad detrás de la norma, así se puede observar uno de los pilares del sistema progresivo y del derecho penal garantista es la resocialización como función de la pena, al ver que la resocialización se logra en gran medida por el acompañamiento familiar se ha estudiado en el Establecimiento Penitenciario de Alta y Mediana Seguridad de Girón la población reclusa y su familia quien esta en contacto constante con el penado y quienes en cierto modo se convierten en víctima del Ius Puniendi estatal. | |
| dc.description.abstractenglish | This work exposes clearly the penitentiary problematics that affects the Colombian society due to the fact that there isn't a criminal politics which guarantees the respect for the Human Rights inside the prisons and offsets the constant outbreaks of violence in the society and in the prisons. There has been promoted in the national government the creation of new penitentiary establishments trying to cut institutionally the violence organized inside the centers of imprisonment, establishing priority in the safety to the interior of the centers over the guarantees and fundamental rights of the persons deprived of the freedom observing that to all lights the evolution of the resocialization has remained stagnant inside the centers of imprisonment. To verify this hypothesis the regime of visits is observed in the Penitentiary Establishment of High and Medium Safety of Girón which belongs to the New Penitentiary Culture where the reality is observed behind the norm, so it can observe one of the props of the progressive system and of the garantist criminal law is the resocialization as function of the prison, on having seen that the resocialization is achieved to a great extent by the familiar accompaniment the population has been studied in the penitentiary establishment of high and medium safety of Girón when his family this who in constant contact with the convict and those who in certain way turn into victim of the state Ius Puniendi. | |
