dc.description.abstract	En el marco de la defensa de los derechos laborales, proteger el acceso a una calificación a la perdida de la capacidad laboral es una necesidad, en territorios donde predominan las actividades laborales de alto riesgo como es la industria de la palma de aceite los accidentes laborales o las enfermedades generadas con el paso del tiempo son muy comunes entre trabajadores, generando que por miedo a ser despedido el trabajador oculte su malestar y no busque respuesta médica y jurídica inmediata. El desconocimiento del trabajador en el proceso de calificación resulta en dictámenes distantes a la realidad médica y social ya que se desconoce que estos pueden ser apelados. Este trabajo busca la promoción y protección del derecho a la calificación de la perdida de la capacidad laboral de los usuarios del Centro de Atención Laboral de Puerto Wilches en la región del Magdalena medio por medio de mecanismos jurídicos apoyado en la relación e interacción directa con el trabajador y el territorio, permitiendo entender así la necesidad y realidad social especifica. Esto, acompañado de un aprendizaje jurídico y social enriquecedor para el practicante de la Escuela de Derecho de la Universidad Industrial de Santander, permitiendo entender el derecho como mecanismo de defensa del más necesitado.
dc.description.abstractenglish	Within the framework of the defense of labor rights, protecting access to a qualification to the loss of work capacity is a necessity, in territories where high-risk work activities predominate, such as the oil palm industry, occupational accidents or diseases generated over time are very common among workers, discovering that for fear of being fired the worker hides his discomfort and does not seek immediate medical and legal response. The lack of knowledge of the worker in the qualification process results in opinions that are distant from the medical and social reality since it is unknown that these can be appealed. This work seeks the promotion and protection of the right to qualify for the loss of work capacity of the users of the Labor Care Center of Puerto Wilches in the Magdalena Medio region through legal mechanisms supported by the relationship and direct interaction with the worker and the territory, thus allowing to understand the need and specific social reality. This, accompanied by an enriching legal and social learning for the practitioner of the School of Law of the Industrial University of Santander, allowing to understand the law as a defense mechanism for the most needy.
