RESUMEN Los artículos 15 y 16 del código civil colombiano, así como el régimen de la inexistencia y las nulidades del derecho privado, señalan los límites al ejercicio de la actividad contractual. Este artículo analiza el campo de acción de la voluntad de la libertad contractual y especialmente las barreras no definidas por el legislador, como son la costumbre, la moral social y el orden público. SUMMARY The limits of the free contractual activity are shown by articles 15 and 16 of the Colombian Civil code, and by the related regulation of civil nullities. This essay is focused in the contractual will and specially in the legal barriers imposed to this field by the law, such as social moral, custom, and public order.
