RESUMENEl Juez de ejecución de penas como garante de la legalidad en la sanción penal ha de velar por la materialización de una política criminal coherente con la finalidad de la pena en su ejecución, siendo los subrogados penales y los beneficios administrativos medidas dise-ñadas por el legislador en aras de una reinserción social, orientada a una política penitencia-ria que en caso de la presente investigación considere la naturaleza del delito político. El contexto social colombiano exige una readecuación en la política criminal y penitenciaria, fundamentada en parámetros de constitucionalidad.Palabras Claves: ejecución penal, delito político, subrogados penales.
ABSTRACTThe sentence enforcement judge as a guarantor of the legality of the sentence has to oversee the materialization of coherent criminal policies with the purpose of the execution of pun-ishments, being the penal subrogates and the administrative benefits norms designed by a legislator in pro of social reinsertion, oriented towards a prison policy which in case of the present investigation considers the nature of the political crime. The social context of Co-lombia requires a remodeling of the political crime and penitentiaries based on constitutional parameters.Key Words: execution judge, political crime, penal subrogates.
