dc.description.abstractLa presente investigación pretende contribuir a los estudios sobre criminalidad que se han realizado para el caso de Santander, a principios del siglo XX. Concentrándose en un delito que para la época generaba consternación entre las personas del común, pero sin mayor importancia dentro del sistema judicial, el cual era el infanticidio, o la muerte de recién nacidos en mano de su propia madre. Por medio de expedientes judiciales y periódicos de la época se reconstruyo características del delito y de las sindicadas, que muestran como las condiciones económicas y sociales de las mujeres procesadas, influyeron notoriamente en la realización del ilícito. Estas circunstancias producidas por las guerras partidistas del final del siglo XIX, se reflejaron en un aumento de criminalidad en el departamento de Santander. Una característica primordial que se puede apreciar a lo largo del trabajo, es la importancia y trascendencia que se le da al concepto de Honor, ya que toda la investigación judicial, desde el mismo código penal vigente para la época, el peritaje y la objetividad del juez; estaban cargadas con juicios morales, que mostraban el papel de inferioridad de las mujeres en relación de los hombres. También hay que tener en cuenta la influencia de la iglesia católica, que a través del ideal mariano, ejerció un control rígido sobre la sexualidad y maternidad.
dc.description.abstractenglishThis research aims to contribute to studies of crime that have been made in the case of Santander, in the early twentieth century. Focusing on a crime at the time generated consternation among ordinary people, but more important within the judicial system, which was infanticide, or newborn death in his mother's hand. Through court records and newspapers of the time characteristics of the offense was rebuilt and the accused, showing how the economic and social conditions of women processed notoriously influenced in the performance of the offense. These circumstances produced by the partisan wars of the late nineteenth century, were reflected in an increase in crime in the department of Santander. A primary characteristic that can be seen throughout the work, is the importance and significance that is given to the concept of honor, as all judicial inquiry, from the same penal code in force at the time, expertise and objectivity judge, were charged with moral judgments, showing the role of inferiority of women in relation to men. We must also take into account the influence of the Catholic Church, that through the ideal Marian exercised tight control over sexuality and motherhood. History
