dc.description.abstractEl documento aborda la problemática de la tenencia de tierras que existe en Colombia, específicamente en el sector rural quienes por falta de garantías estatales no han podido legalizarlas, generando tensión cuando un proyecto de interés nacional pasa por su predio y para negociar la servidumbre se debe contar y/o demostrar la titularidad del mismo; es así, que empresas como ISA Intercolombia (empresa transportadora de energía) al llegar a un territorio se ve en la necesidad de negociar y el propietario al no demostrar su titularidad solo puede pagarle mejoras, lo que genera conflicto entre propietarios y empresas. Por esta razón la presente investigación buscó conocer el estado actual de la tenencia de la tierra de los habitantes del sector las Vizcaínas del municipio de San Vicente de Chucurí y la experiencia de los actores involucrados en el proceso de adquisición de servidumbres del proyecto de interconexión eléctrica asociado a la línea Porce III Sogamoso, con el fin de proponer una estrategia de intervención que mitigue dicha problemática, para ello, se realizó un estudio de caso con entrevistas a profundidad que permitieron identificar que el principal conflicto es la forma de la tenencia con principales factores como la concentración de la tierra, los baldíos y cartas ventas; de igual forma, la percepción que se tiene frente a las servidumbres es el desconocimiento de los procesos que se realizan al momento de la negociación de servidumbre, por lo que, se hace necesario fortalecer los vínculos de confianza entre empresapropietario que permitan ver procesos de negociación transparentes y de orientación en los procesos. Finalmente, se resalta la evidente brecha que existe en el sector rural frente a políticas agrarias, las cuales, no han permitido la titularidad de los predios que habitan generando conflicto con la llegada de proyectos de interés nacional
dc.description.abstractenglishThis study approaches the problem regarding the land tenure that exists in Colombia, specifically in the rural sector, on which due to lack of state guarantees have not been able to legalize them. In consequence, generates tension whenever a project of national interest must pass through their property and to negotiate the easement must be counted and / or demonstrate the ownership thereof; Thus, In the arrival of energy transport companies into these territories, such as ISA Intercolombia (in spanish: empresa transportadora de energíaenergy transport company), are forced to negotiate and the owner cannot prove ownership of it, they can only pay for improvements, which generates conflict between owners and companies. For this reason, the present investigation sought to know the current state of land tenure of the inhabitants of the Las Vizcainas sector the municipality of San Vicente de Chucurí and the impact that the acquisition of project easements generates from the perception of the actors involved. In order to propose an intervention strategy that mitigates that problematic, electrical interconnection associated with the Porce III - Sogamoso line,for which, a case study was carried out with indepth interviews that allowed identifying that the main conflict is the form tenure with main factors such as land concentration, vacant lots and sales letters. Likewise, the perception of servitude iis ignorance of the processes that are carried out at the time of the servitude negotiation; therefore, it is necessary to strengthen the bonds of trust between the companyowner that allow seeing processes of transparent negotiation and guidance in the processes. Finally, it is important to highlight the evident gap that exists in the rural sector in the face of agrarian policies, which have not allowed the ownership of the properties they inhabit, generating conflict with the arrival of projects of national interest
