dc.description.abstractEste trabajo de grado se realizó en ejercicio del control fiscal delegado en cabeza de la Contraloría Municipal de Bucaramanga, y, su propósito principal era el verificar por primera vez, la forma en que la Administración Central ha venido manejando el Portafolio de Inversiones de Renta Variable del Municipio de Bucaramanga, y analizar si dicho manejo se adecuaba al cumplimiento de los fines constitucionales del Estado y de los principios de la función administrativa y de la gestión fiscal. Para la realización de este estudio, se tuvo en cuenta la información suministrada por cada una de las empresas conformantes del Portafolio de inversión y por las dependencias de la Alcaldía de Bucaramanga. Los resultados arrojados permitieron establecer que el Gobierno Municipal ha caído en yerros en la administración del Portafolio objeto de estudio, que además de representar infracciones legales, evidencian un actuar en contravía de los fines y principios por los que debe regirse la función administrativa. Teniendo en cuenta que la práctica jurídica social realizada pretendía un ejercicio académico, se plantearon una serie de recomendaciones dirigidas al Gobierno Local y a la Contraloría Municipal, que si bien no tienen ningún poder coercitivo, pretenden concienciar a estas dos entidades de la importancia que reviste este Portafolio dentro del patrimonio público municipal.
dc.description.abstractenglishThe following dissertation was done under the practice of fiscal regulation by the Municipal Audit Office of Bucaramanga and, its main goal is to verify, for the very first time, the means that the Central Administration has been using to manage the Portfolio of Investments of the Fluctuating Interest Rate in the city of Bucaramanga. The purpose of the analysis is to unveil if such management fulfilled with the Constitutional Aims of the Colombian State and the principles of the Administrative Function in the fiscal supervision. For performing this study, all the information supplied by each one of the companies associated to the Portfolio of Investments of the Fluctuating allowed us to determine that the local administration has committed some mistakes in the management of the portfolio studied; this represents illegal infractions that show how contrary this behavior is to the administrative function regulations is. Having in mind that the social legal practice performed wanted to be part of an academic exercise; some recommendations were addressed to the local administration and to the Municipal Audit Office in order to raise awareness of the importance that this portfolio has for the municipal wealth, despite this last institution cannot practice any coercive power.
