| dc.description.abstract | Esta tesis describe y analiza la cárcel La Concordia de Bucaramanga: desde la ley, el preso y la prensa local. Expone las formas que históricamente se han utilizado para castigar los comportamientos ilegales. Explorando las teorías penales que influenciaron leyes y decretos que reglamentaron estos organismos de control social en Colombia, describiendo como debería ser su funcionamiento y organización de acuerdo con los objetivos propuestos. Contrastando estas leyes con las condiciones reales de estas instituciones, primero a través de informes oficiales y luego con el testimonio del presidiario Luis Maria Millán en 1940, quien sufre la privación de la libertad “La Concordia”. Su manuscrito proporcionó información para dimensionar el distanciamiento entre la ley y su aplicación. Finalmente se utiliza un diario local donde se difunden editoriales, crónicas, entrevistas e informes sobre lo carcelario lo policivo y lo judicial en Bucaramanga y el Departamento, indagación que permitió reconstruir y analizar la versión que Vanguardia Liberal difundía a través de sus discursos sobre las condiciones carcelarias, haciendo posible corroborar los informes de los funcionarios y la versión de Millán Triviño sobre las pésimas condiciones materiales y de organización que contrastaban con lo que proponía el gobierno en la década 1930, modernizar cárceles y penitenciarias para el estudio sistemático del delincuente y su readaptación. Dentro de las conclusiones se encuentran las causas que impidieron la anhelada reforma carcelaria de 1934, se identificaron las razones políticas, fiscales y teórico penales que generaban el mal estado de cárceles y penitenciarias. El aporte de esta investigación se encuentra en que se presenta la vivencia dentro de la cárcel la Concordia, mostrando lo que significaba para el presidiario su encierro y las consecuencias en su comportamiento, dimensionando el fracaso de la Institución total cárcel en cuanto a sus fines de readaptación social de los delincuentes. | |
| dc.description.abstractenglish | This thesis describes and it analyzes the jail La Concordia of Bucaramanga: from the law, the prisoner and the local press. It exposes the forms that historically have been used to punish the illegal behaviors. Exploring the penal theories that influenced laws and ordinances that regulated these organisms of social control in Colombia, describing like it should be their operation and agreement organization with the proposed objectives. Contrasting these laws with the real conditions of these institutions, first through official reports and then with the convict's testimony Luis María Millán in 1940 who suffers the privation of the freedom "La Concordia." Their manuscript provided information for dimensioned the distancing between the law and its application. Finally a local newspaper is used where they spread editorials, chronicles, interviews and reports on the prison thing the policy and the judicial thing in Bucaramanga and the Department, inquiry that allowed to reconstruct and to analyze the version that Vanguardia Liberal diffused through its speeches on the prison conditions, making possible to corroborate the reports of the officials and the version of Millán Triviño on the terrible conditions materials and of organization that you/they contrasted with what the government proposed in the decade 1930, to modernize jails and penitentiary for the criminal's systematic study and his readaptation. Inside the conclusions they are the causes that impeded the one yearned prison reformation of 1934, the political, fiscal and theoretical penal reasons they were identified that generated the not well state of jails and penitentiary. The contribution of this investigation is in that shows up the vivencia inside the jail La Concordia, showing what meant for the convict its confinement and the consequences in its behavior, dimensioned the failure of the Institution total jail as for its ends of the criminals' social readaptation. | |
