dc.description.abstractEsta aproximación investigativa tuvo por objetivo identificar las definiciones de los conceptos de memoria y víctimas en la Ley colombiana 1448 del 2011, en el libro Justicia de las víctimas. Terrorismo, memoria, reconciliación de Manuel Reyes Mate y en el texto Los abusos de la memoria de Tzvetan Todorov. Una vez hecho, se procedió a una sucinta reflexión que relacionó las definiciones de los mencionados filósofos y la ley en el caso colombiano. De esta manera, el artículo se organizó en cuatro acápites. En el primero, se realizó una breve contextualización de las discusiones políticas que antecedieron a la promulgación de la ley, además de identificar y caracterizar las definiciones de los conceptos de memoria y de víctimas en la Ley 1448. En el segundo, se caracterizó la memoria como un elemento directamente relacionado con la justicia en que, su finalidad, radica en la reconciliación del tejido social. En el tercero, se describió el concepto de víctima como una categoría moral y de justicia que, a través de los testimonios, difunde una nueva interpretación de las injusticias del pasado y del presente. Finalmente, en el último capítulo, se articulan las definiciones teóricas de memoria y de víctimas con la aplicación en Colombia de la Ley 1448.
dc.description.abstractenglishThis research approach aimed at identifying definitions of memory and victim concepts in Colombian Law 1448 of 2011, in the book Justice of Victims. Terrorism, memory, reconciliation of Manuel Reyes Mate and in Tzvetan Todorov's book The abuses of memory. Once done, a succinct reflection was carried out to relate the definitions of those mentioned philosophers and the law in the Colombian case. In this way, the article was organized into four headings. In the first one, a brief contextualization of the political discussions enacting the law, in addition to identifying and characterizing the definitions of the concepts of memory and victims in Law 1448. In the second, memory was characterized as an element directly related to justice in which its purpose lies in the reconciliation of the social fabric. In the third, the concept of victim was described as a category of morality and justice that, through the testimonies, spreads a new interpretation of the injustices of the past in the present. Finally, in the last chapter, the theoretical definitions of memory and victims are articulated with the application in Colombia of Law 1448.
