dc.description.abstractLa presente monografía para optar al título de abogado, da respuesta al siguiente problema de investigación sociojurídica: ¿La Administración Pública vulnera la Moralidad Administrativa, cuando contrata al personal docente por medio de órdenes de prestación de servicios, desconociendo el Principio de la Primacía de la Realidad sobre las Formas? En tal sentido el informe final de la investigación se estructura de la siguiente manera. La primera etapa comprende la fundamentación teórica, donde a la luz de la Jurisprudencia, la Doctrina y la legislación, se expondrán los fundamentos teóricos y jurídicos que dan sostén al presente trabajo de investigación. La segunda etapa comprende el Trabajo de campo, consistente en analizar el caso concreto presente en la investigación: Caso Sonia Patricia Barragán Gutiérrez, Docente del Municipio de Piedecuesta. La tercera es la etapa de síntesis y resolución del problema de investigación. Al llegar a ésta etapa, nos permitimos desarrollar el objetivo principal el cual es: Establecer la afectación a la Moralidad Administrativa, cuando la administración desconoce el Principio de la Primacía de la Realidad sobre las Formalidades al contratar el personal docente por medio de órdenes de prestación de servicios. A ésta altura de la investigación, se procede a sintetizar toda la información reunida hasta éste momento; a partir de ahí, se propone la resolución al problema socio-jurídico planteado, permitiéndonos proyectar conclusiones como resultado del análisis al fenómeno jurídico.
dc.description.abstractenglishThis undergraduate paper in order to get the lawyer’s bachelor degree answers to the following problem of socio-juridical research: Does the public administration infringe the Administrative Morality when hiring teachers by services contract, ignoring the Primacy of Reality upon Forms principle? In this sense, the final research report is structured by the following methodology: The first stage involves the law theoretical research and according to the jurisprudence, the doctrine and the legislation, the conceptual contents, on which this research is based, are going to be exposed. On the second moment, the fieldwork consists in the interpretation and analysis process of a specific case: Sonia Patricia Barragán Gutierrez’s Case, teacher in the municipality of Piedecuesta. The third stage entails the synthesis and resolution of the investigation problem. Accomplishing this moment is actually important to develop the main objective of the research: To establish the effect in the Administrative Morality, when the administration ignores the Primacy of the Reality upon the Formalities, hiring teacher by services contracts. Right away, the research proceeds to synthesize all the information compiled until now; from there, the resolution of the socio-juridical problem is proposed. This resolution lets the research to plan conclusions as the result of the juridical phenomenon.
