dc.description.abstractEl objetivo de la presente monografía es dar cuenta, como fruto del desarrollo de la doctrina, la jurisprudencia y las normatividad, internacional y nacional, el derecho a la tierra adquiere la condición de Derecho Humano, que debido al conflicto armado interno que se vive en Colombia, la acumulación de tierras y el control de territorios por parte de los grupos armados irregulares, se produce una vulneración reiterada de este derecho a través del desplazamiento forzado por la violencia. Como una respuesta a esta problemática el Estado ha creado una serie de acciones especiales para la protección de la tierra y el patrimonio de la población desplazada, las cuales son: la declaratoria de inminencia de riesgo de desplazamiento y el registro único de predios abandonados por la violencia; y la reparación de las víctimas del despojo, a través de los mecanismos creados por la ley 975 de 2005, conocida como Ley de Justicia y Paz. Estas acciones son descritas y analizadas críticamente en la presente monografía, a la luz de su eficacia para dar respuesta a la compleja problemática de tierras que vive la población desplazada, y su idoneidad para garantizar la protección y restitución de las tierras abandonadas y despojadas, como consecuencia del conflicto.
dc.description.abstractenglishThe aim of the present monograph is realize, as fruit of the development of the doctrine, the jurisprudence and the normatividad, international and national, the right to the land acquires the condition of Human right, which due to the armed internal conflict that one lives in Colombia, the accumulation of lands and the control of territories on the part of the armed irregular groups, produces to itself a repeated violation of this right across the displacement forced by the violence. Since a response to this problematics the State has created a series of special actions for the protection of the land and the heritage of the displaced population, which are: the declaration of imminence of risk of displacement and the only record of lands left by the violence; and the repair of the victims of the spoliation, across the mechanisms created by the law 975 of 2005, known as Law of Justice and Peace. These actions are described and analyzed critically in the present monograph, in the light of his efficiency to give response to the complex problematics of lands through that the displaced population lives, and his suitability to guarantee the protection and restitution of the left and cleared lands, as consequence of the
