dc.description.abstractEn el presente trabajo de investigación se propone la investigación de la figura de la víctima de violencia sexual comúnmente manejada en la política criminal y derecho penal colombiano. Para esto se investigaron las aristas correspondientes a los delitos en cuestión para la conceptualización de violencia sexual y la función social del Estado al investigar y sancionar ciertas conductas. Ahora bien, el eje diferencial y primordial del presente trabajo de investigación se compone en los sujetos de este punible estudiado, el cual se compondría de un sujeto activo femenino y sujeto pasivo masculino de los cuales se logre establecer una fecundación acuñada directamente a la consecución del delito. En este eje central se busca investigar si existen circunstancias especiales o medidas de protección de las que se pueda revestir la víctima para proteger su dignidad que afecten directamente a la concepción de este nasciturus fruto del punible. Adicionalmente, se investigarán cuestiones accesorias necesarias para la resolución completa de la investigación correspondientes a las cuestiones sociológicas que orillan a la invisibilización del problema, y las causas de esta misma índole tanto exógenas como endógenas que influyen en la consecución de este tipo de conducta delictiva junto con un análisis final de las garantías fundamentales en colisión.
dc.description.abstractenglishIn the present research work, the investigation of the figure of the victim of sexual violence commonly handled in criminal policy and Colombian criminal law is proposed. For this, the edges corresponding to the crimes in question were investigated for the conceptualization of sexual violence and the social function of the State when investigating and punishing certain behaviors. Now, the differential and primordial axis of this research work is made up of the subjects of this punishable offense studied, which would be made up of a female active subject and a male passive subject of which it is possible to establish a fertilization coined directly to the achievement of the crime. In this central axis, it seeks to investigate whether there are special circumstances or protection measures that the victim can apply to protect their dignity that directly affect the conception of this unborn child, the fruit of the punishable. Additionally, accessory issues necessary for the complete resolution of the investigation corresponding to the sociological issues that lead to the invisibility of the problem will be investigated, and the causes of this same nature, both exogenous and endogenous, that influence the achievement of this type of criminal behavior together with a final analysis of the fundamental guarantees in collision.
