dc.description.abstractEl propósito esta práctica jurídico- social, es el de realizar un estudio del régimen de protección de la Propiedad Intelectual adoptado por la Universidad Industrial de Santander, a través el Acuerdo 093 de 2010 del Consejo Superior, actual Reglamento de Propiedad Intelectual. El proceso de desarrollo del trabajo de investigación, parte de un análisis de los tratados internacionales y las organizaciones multilaterales que los administran, así como las leyes expedidas por legislativo colombiano que regulan la materia, con el objetivo de establecer el marco jurídico aplicable. Seguidamente, se realiza el estudio jurídico de las instituciones adoptadas por el vigente Reglamento de Propiedad Intelectual; así mismo, y con el fin de analizar la puesta en práctica de las normas en él consagradas, se analiza los acuerdos de cooperación que la Universidad ha suscrito con terceros. Una vez identificadas las falencias, tanto jurídica como prácticas del vigente régimen de protección a la Propiedad Intelectual, se da inicio al proceso de construcción de propuestas de modificación del vigente régimen de protección de la Propiedad Intelectual, en el cual se tuvo en cuenta, figuras jurídicas adoptadas por otras Universidades.
dc.description.abstractenglishThe purpose of this legal-social practice is to carry out a study of the protection regime of Intellectual Property adopted by the Industrial University of Santander, through the Agreement 093 of 2010 of the Higher Council, current Intellectual Property Regulation. The process of developing the research work is based on an analysis of the international treaties and the multilateral organizations that administer them, as well as the laws issued by the Colombian legislature that regulate the matter, with the objective of establishing the applicable legal framework. Next, the legal study of the institutions adopted by the current Intellectual Property Regulation is carried out; Likewise, and in order to analyze the implementation of the norms enshrined in it, it analyzes the cooperation agreements that the University has signed with third parties. Once the legal and practical shortcomings of the current Intellectual Property protection regime have been identified, the process of constructing proposals for the modification of the current Intellectual Property protection regime begins, for which it is analyzed, the regulations of Intellectual Property adopted by other Universities.
