dc.description.abstractEn esta monografía se busca como objetivo general analizar las ideas propuestas por Jeremy Bentham en torno al principio de utilidad y la teoría de las Ficciones jurídicas (y políticas), en su obra Un Fragmento sobre el Gobierno publicada en 1776. Bajo este objetivo, analizaremos en primera instancia el concepto de utilidad propuesto por Bentham conjugándolo con un segundo concepto que examinaremos en segunda instancia: el concepto de Ficción, en donde se observará a través de Un Fragmento sobre el Gobierno la deliberada falsedad -como él aseguraba- con que la clase dirigente engaña al pueblo (mayoría). Finalmente, se buscará entrelazar y comprender el enlace de la teoría de lo útil y la teoría de ficción política propuesto por el pensador inglés. La Ficción como uno de los instrumentos de la técnica jurídica, fue utilizada desde tiempos remotos por los juristas, sobre todo por los romanos, de quienes era predilecta y a cuyo formalismo se adaptaba perfectamente. Asimismo, a lo largo de la historia del régimen jurídico, el uso de las ficciones ha sido frecuente. Ahora bien, la ficción es un producto de la facultad imaginativa. Las ficciones jurídicas son construcciones ideales que se hacen en las normas de Derecho, a las que se les asigna un valor hipotético o instrumental, debido a su aptitud para facilitar una concepción jurídica o para provocar una realidad deseada o inexistente considerada preferible a la actual y con la finalidad de facilitar la aplicación de los preceptos jurídicos.
dc.description.abstractenglishIn this monograph I sought as general objective to analyze the ideas proposed by Jeremy Bentham concerning the principle of utility and the theory of the juridical Fictions, in his work fiA Fragment on the Government" published in 1776. Under this aim, we™ll examine the first instance the concept of utility proposed by Bentham together it with the second concept that we will examine in the second instance: the concept of Fiction, where it will be observed across "A Fragment on the Governmentfl the deliberate falsehood - as he was assuring - with that the leader class cheats the people (majority). Finally, will seek to understand the interlocking and link the theory of utility and the theory of political Fiction proposed by the English thinker. Fiction as one of the instruments of legal technique, was used since ancient times by the jurists, especially the Romans, who was favored and whose formalism is perfectly suited. Also, throughout the history of the legal system, the use of fiction has been prevalent. But fiction is a product of the imaginative faculty. Legal fictions are ideal constructions made in the rules of law, which are assigned a hypothetical or instrumental value because of its ability to provide a legal conception or to elicit a desired or no actually considered preferable to the current and in order to facilitate the application of legal precepts.
