| dc.description.abstract | Esta tesis ha sido desarrollada con el objetivo de lograr un acercamiento al positivismo jurídico de Niklas Luhmann, y por ende de la necesidad de desligarse de la perspectiva dogmática propia de la sociología tradicional y proponer una nueva mirada e interpretación a la teoría sistémica. Ahora bien, dentro de la construcción de esta teoría sistémica el sociólogo alemán, propone el análisis del derecho como un sistema social, esencialmente comunicativo que posee una codificación binaria y unas características principales, que de una u otra forma constituyen el objeto de estudio y el fundamento para la formulación del problema y el desarrollo del mismo ¿En qué medida el código binario opera como estructura fundamental del subsistema social, autopoiético y autorreferente derecho? Puesto que, se considera que el derecho no sólo debe identificarse como un conjunto de normas, instrumento de poder, regulador de conductas, sino como un sistema que se determina a sí mismo y posee un código que es el regulador de toda la información que ingresa al sistema; él es quien decide si los datos cumplen o no con las pautas normativas exigidas por el esquema binario. Ahora bien, en este esquema, predominan dos factores significativos o distinciones, que son calificados como reglas internas al código, encargadas de identificar y de asignar a la información procesada su correspondiente valor y así su aceptación o rechazo dentro del subsistema. La binariedad implica la presencia de dos opciones, que en el sistema del derecho están conformadas por: conforme a derecho y no conforme a derecho; diferenciación que conlleva a una mejor organización y distribución del sistema. | |
| dc.description.abstractenglish | This thesis has been developed in order to approach the Niklas Luhmann’s legal positivism theory,and also the needing of separating from the own traditional dogmatic perspective of sociology topropose a new look and interpretation to the systemic theory. Now, within the construction of thistheory the German systemic sociologist, proposes the analysis of the law as a social system,essentially communicative that owns a codification and some unique binary code and some keyfeatures, which constitutes the object of study and the base to propose the problem and itsdevelopment. éln which measure the binary code works as a mean structure of the social, selfreferable and autopoietic law subsystem? Since, the law is considered that this law should not onlybe identified as a set of rules, instrument of power, regulator of behavior, but as a system that isdetermined by itself and possesses a code that is the regulator of all this information that comesinto the system, it is the one which decides if the data fulfill with the required patterns by the binaryschemes. Now, in this scheme, predominates two significant factors or distinctions, which are qualified asinternal rules of the code, in charge of identifying and assigning to the processed information itscorresponding value and its acceptance or rejection within the subsystem.
