dc.description.abstractEn esta investigación semiótica jurídica alrededor de las normas del secreto profesional del abogado en Colombia se abordó la Carta Política, la Ley y la Jurisprudencia de la Corte Constitucional desde 1991 hasta el 2021. En una primera parte, se presenta el objeto de investigación y se establece la relación entre la semiótica y el derecho a través de una delimitación teórico metodológica enmarcada en la teoría semiótica de la Escuela de París, la cual toma tanto elementos de la semiótica discursiva como de la sociosemiótica o, más precisamente, se sitúa en una semiótica jurídica. En la segunda parte, se presenta el análisis semiótico jurídico alrededor de las normas del secreto profesional del abogado en Colombia, es decir, se caracterizan los discursos jurídicos vigentes que instauran la inviolabilidad. De allí que, en los discursos jurídicos declarativos se precisa el secreto profesional en la Carta Política y en la Ley. Mientras que en los discursos jurídicos argumentativos se definen las tendencias de producción e interpretación normativa del secreto profesional en el precedente jurisprudencial de la Corte Constitucional. Igualmente se dilucida el precepto jurídico a través de una dimensión interpretativa, una dimensión situacional, una dimensión etiológica y una dimensión vivencial mediante representaciones y metarrepresentaciones semióticas que describen los modos de existencia de la inviolabilidad del secreto profesional del abogado y sus estrategias.
dc.description.abstractenglishIn this semiotic legal investigation around the rules of professional secrecy of the lawyer in Colombia, the Political Charter, the Law and the Jurisprudence of the Constitutional Court from 1991 to 2021 were addressed. In the first part, the object of the investigation is presented and the establishes the relationship between semiotics and law through a theoretical-methodological delimitation framed in the semiotic theory of the School of Paris, which takes both elements of discursive semiotics and socio-semiotics or, more precisely, is situated in a semiotic legal. In the second part, the legal semiotic analysis around the rules of professional secrecy of the lawyer in Colombia is presented, that is, the current legal discourses that establish inviolability are characterized. Hence, in declarative legal discourses, professional secrecy is specified in the Political Charter and in the Law. While, in argumentative legal discourses, the production trends and normative interpretation of professional secrecy are defined in the jurisprudential precedent of the Court. Constitutional. Likewise, the legal precept is elucidated through an interpretive dimension, a situational dimension, an etiological dimension and an experiential dimension by means of semiotic representations and meta-representations that describe the modes of existence of the inviolability of professional secrecy and its strategies.
