dc.description.abstractEl Juez de Tutela, en sus providencias judiciales antes de proceder a emitir un fallo, realiza un proceso hermenéutico de la realidad fáctica que se somete a su consideración, así como de los textos normativos, constitucionales, jurisprudenciales entre otros, a fin de garantizar los derechos de las partes, legalidad del proceso y seguridad jurídica. El presente trabajo se encuentra estructurado de manera que permita al lector a partir de la revisión de las principales teorías y métodos de interpretación, conocer los cánones hermenéuticos utilizados por los jueces Civiles municipales y de Circuito, en los fallos de las Acciones de tutela realizadas por los estudiantes del Consultorio Jurídico de la USTA Bucaramanga, período 2005-2008, en materia de protección al derecho a la salud. Los fallos fueron analizados a partir de los métodos de interpretación (sociológico, sistemático, exegético y el precedente, con sus correspondientes técnicas de acuerdo a la estructura de los profesores Jaime Giraldo Ángel y Diego López Medina.); resultados que se registraron en el instrumento de medición denominado fiProtocolo de análisis de Fallos de Tutela, período 2005-2008fl y que permitió llegar a importantes conclusiones y recomendaciones. Se pretende demostrar con la presente investigación, que a pesar de que La Corte Constitucional ha hecho grandes esfuerzos para estructurar un precedente vinculante especialmente en materia de protección de Derechos fundamentales, los jueces municipales y del circuito de Bucaramanga, intentan realizar sus interpretaciones basados en un aparente seguimiento al precedente; sin embargo no dejan de lado otros métodos tradicionales, los que son utilizados precisamente para apoyar sus interpretaciones. De otro lado se demostrará igualmente que la aplicación del precedente no se realiza con las técnicas debidas, derivándose por tanto, la aplicación de una mera jurisprudencia indicativa.
dc.description.abstractenglishProbate Judge, in his judicial decisions prior to issuing a decision, takes a hermeneutic process of factual reality that is submitted for his consideration, as well as legal texts, constitutional, judicial amongst others, to ensure the rights of the parties, due process and legal certainty. This work is structured to allow the reader from the review of the main theories and methods of interpretation, to know the hermeneutical canons used by municipal civil and circuit judges about the decisions of actions for tutela carried out by students of the legal office of Universidad Santo Tomas in Bucaramanga from, 2005 to 2008, in protecting the right to health. The verdicts were analyzed from the methods of interpretation (sociological, systematic, exegetical and precedent, with their respective techniques according to the structure of the teacher Jaime Giraldo Angel and Diego Lopez Medina.) Results were recorded in the instrument measurement called " Analysis Protocol of verdict for tutela period 2005-2008 and that allowed to reach important conclusions and recommendations. The aim of this investigation is to demonstrate that although the Constitutional Court has made great efforts to structure a binding precedent especially in the protection of fundamental rights, municipal and circuit judges of Bucaramanga, try to make their interpretations based on a apparent following of the precedent, but do not neglect traditional methods, which are used specifically to support their interpretations. On the other hand it also be demonstrated that application of the precedent is not performed with the due techniques, deriving thus, by applying a mere indicative case.
