dc.description.abstractEl presente artículo realiza una reflexión resultado de la investigación acerca de la interrupción voluntaria del embarazo, a través del análisis de la Sentencia C-355 de 2006, que despenaliza la interrupción voluntaria del embarazo en Colombia en tres causales excepcionales, estas son: a consecuencia de una violación, inseminación artificial no consentida o incesto, por malformación fetal que haga inviable la vida del feto fuera del útero y cuando el embarazo ponga en riesgo la salud o vida de la mujer. La Sentencia se analizará a partir del concepto de intimidad, que será rastreado en lo propuesto por la filósofa Judith Jarvis Thomson, en su artículo Una defensa del aborto. La reflexión se desarrolla en tres momentos: el primero de ellos, contextualiza el debate iusfilosófico en torno a la interrupción voluntaria del embarazo, así como aborda los conceptos de libertad, intimidad y autonomía, trabajados en otros textos académicos relacionados con la interrupción voluntaria del embarazo; el segundo, rastrea el concepto de intimidad, en la obra base de esta investigación, y en la Sentencia Roe vs Wade, primera discusión sobre la temática; y, el tercero, aborda lo desarrollado por la Corte Constitucional a partir del concepto de intimidad planteado por la autora Judith Jarvis Thomson.
dc.description.abstractenglishThe present article makes a reflection result of an investigation about the voluntary termination of the pregnancy, through the analysis of the Sentence C-355 from 2006, which decriminalize the voluntary termination of the pregnancy in Colombia in three causals exceptionalities, them are: a consequence of a violation, an artificial insemination without consent or incest, due to fetal malformation that makes the life of the fetus unviable outside the uterus and when the pregnancy endangers the health or life of the woman. The Sentence will be analyzed based on the concept of intimacy, which will be tracked in the propose by the philosopher Judith Jarvis Thomson, in her article A Defense of Abortion. The reflection develops in three moments: the first of them, contextualizes the iusphilosophical debate around the voluntary termination of the pregnancy, as well as accost the concepts of freedom, intimacy and autonomy, worked in other academic texts related to the voluntary interruption of pregnancy; the second one, tracks the concept of intimacy in the work base of this investigation, and in the Sentence And Roe vs Wade, first discussion on the subject; and, the third one, addresses the developed by the Constitutional Court based on the concept of intimacy carried out by the author Judith JarvisThomson.
