dc.description.abstractA través del siguiente texto el lector encontrará un análisis normativo y jurisprudencial del principio de neutralidad en la red, a partir de un estudio del caso Uber en Colombia, a efectos de determinar si en Colombia se vulneró o no este principio. Con el propósito de realizar este estudio, se abordará en un primer momento la regulación del principio que se halla en el país, posteriormente se hará una conceptualización del término de economía colaborativa, a fin de comprender el impacto que ha tenido la tecnología disruptiva en la economía. Una vez hecho esto, se procederá a examinar la decisión adoptada por la Superintendencia de Industria y Comercio del 20 de diciembre de 2019, por medio de la que se adoptó una decisión de bloqueo hacía la plataforma digital Uber, para conocer a profundidad los argumentos utilizados por la Superintendencia para tomar la decisión. Tras esto, se realizará un estudio jurisprudencial de casos análogos presentados en distintos países, en busca de conocer las distintas posiciones que se han adoptado en la materia. A partir de todo lo anterior, se propondrán los criterios de aplicación del principio, y con estos, se estudiará la decisión adoptada por la Superintendencia, para determinar si hubo o no, la vulneración del principio de neutralidad en la red.
dc.description.abstractenglishThrough the following text the reader will find a normative and jurisprudential analysis of the principle of net neutrality, based on a study of the Uber case in Colombia, in order to determine whether or not this principle was violated in Colombia. In order to carry out this study, the regulation of the principle found in the country will be addressed at first, then a conceptualization of the term collaborative economy will be made, in order to understand the impact that disruptive technology has had on the economy. Once this is done, we will proceed to examine the decision adopted by the Superintendence of Industry and Commerce of December 20, 2019, through which a decision was adopted blocking the digital platform Uber, to know in depth the arguments used by the Superintendency to make the decision. Following this, a caselaw study of similar cases presented in different countries will be carried out, in order to learn about the different positions that have been adopted in the matter. On the basis of the foregoing, the criteria for the application of the principle will be proposed and, with them, the decision taken by the Superintendence will be examined to determine whether or not there was a breach of the principle of net neutrality
