dc.description.abstractEl Código de Infancia y Adolescencia en Colombia, Ley 1098 del 2006, implementa el nuevo Sistema de Responsabilidad Penal para Adolescentes (SRPA), el cual propone a los sistemas de justica juvenil la adopción de mecanismos restaurativos de desjudialización, sanciones no privativas de la libertad o de medio abierto: amonestación, reglas de conducta, prestación de servicios a la comunidad y libertad asistida. Bucaramanga y su Área Metropolitana carecen de entidades que ofrezcan la sanción en modalidad de prestación de servicios a la comunidad, considerada como una medida con significativo potencial restaurativo, debido a la reintegración positiva de la víctima, el ofensor y la comunidad. Por lo anterior se diseña una alternativa social en modalidad de servicio a la comunidad para jóvenes en conflicto con la ley, que brinde una atención integral y oriente de manera pertinente en la creación de su nuevo proyecto de vida, como herramienta fundamental para surgir en la legalidad; basada en justicia restaurativa con carácter responsabilizador, reparador y reintegrador. Desde la práctica de Trabajo Social se construye la propuesta de sanción mediante estrategias de participación, educación y sensibilización, esbozada en este documento, con el fin de evidenciar practicas afines a la justicia restaurativa que le apuesten a la mediación, conciliación, reparación de la víctima y transformación del adolescente en conflicto con la ley.
dc.description.abstractenglishThe Children’s and Adolescent’s Code in Colombia, Law 1098 of 2006, introduces the new Criminal Justice System for Adolescents (SRPA), which proposes to the juvenile justice systems, the adoption of de-judicialization’s restorative systems, non-custodial measures or open regimen: warning, rules of conduct, provision of services to the community and assisted liberty. Bucaramanga and its Metropolitan Area lack of organizations who can offered the penalty in the provision of services methods to the community, considered as a measure with significant restorative care, due to the positive reinstatement of the victim, the offender and the community. Therefore, a social alternative is design in the provision of services method to the community for young people in conflict with the law, which provides an integral attention and guides in an appropriate way in the creation of their new project life, as a crucial tool for coming back with the legality; based on the restorative justice with conductive, repairing and integrative character. From the Social Work practice, it is built a penalty design by participation strategies, education and increased sensitivity, outline in this project, with the aim to show practices related to restorative justice that bet on mediation, conciliation, victim repairing and transformation of teenagers in conflict with law
