dc.description.abstractLa presente investigación describe las actuaciones de justicia del licenciado Juan Montaño mientras se desempeñó como oidor de la Real Audiencia de Santafé entre los años de 1553 a 1557, debido a la importancia que tenía este funcionario en la estructura del Estado monárquico hispano como máximo representante de la función principal del Rey: hacer justicia. El trabajo se centró en observar desde un caso particular las implicaciones que tenía para la monarquía los aciertos y desaciertos cometidos de un hombre como Montaño, investido con dignidades y poderes elevados y cuya garantía de sus acciones estaba reducida a la confianza en su conciencia y moral. Las actuaciones del oidor Juan Montaño en la Audiencia de Santafé se desarrollaron en un ambiente de inestabilidad creado por la acefalía de la institución y la conformación de un gobierno colegiado, donde los oidores asumieron como un solo cuerpo las funciones de quien debía presidirla. Esta situación dio lugar a un sinnúmero de disputas y enfrentamientos entre los mismos oidores, quienes para mantener su autoridad y poder establecieron alianzas con los conquistadores y encomenderos, extralimitando sus funciones y trasgrediendo las normas que se les imponían como representantes del poder real. El oidor Montaño no fue ajeno a estas circunstancias, sus propias necesidades lo hicieron traspasar los límites de su deber y a cometer errores en su actuar como juez, que lo llevaron a ser objeto de un juicio de residencia en 1557 en el que se le culpó de 254 cargos; la mayoría de estos correspondían a delitos menores, pero dos de ello relacionaron al oidor con la muerte de Luis Cruzado y Pedro de Salcedo e hicieron que en 1561 el Consejo de Indias lo condenara a Pena Capital.
dc.description.abstractenglishThe present research describes the judicial proceedings about the lawyer Juan Montaño while he served as oidor of the Real Audiencia of Santafé between the years of 1553-1557, this research is important because this officer had an important work in the structure of monarchical Spanish State and he was the head of the main king´s function: justice. This research was focused in watching a particular case and the implications that it had by monarchy, specially the rights and wrongs that was realized by a man like Montaño, who was invested with dignities and high powers, whose only guarantee about his good behaviour was the confidence in his conscience and moral. The judicial proceedings of oidor Juan Montaño in SantaFe´s Audience took place in unstable environment it was produced by an acephalous institution and the establishment of a collegiate government, where the Oidores had assumed such as an only body the functions of who must have presided. This plight allowed a lot of disputes and clashes between oidores, They tried to keep their authority and power through alliances with conquerors and encomenderos, overstepping their roles and transgressing the rules, that rules had being imposed on them because They was a representation of the royal power. Oidor Montaño was not stranger to these circumstances, their own needs did overstep the bounds of their duty and He committed different mistakes in his judicial proceedings, because that, he was the subject of an impeachment trial in 1557 and he was blamed of 254 crimes. A lot of these were misdemeanours, but two of these related to Montaño with the death of Luis Cruzado and Pedro de Salcedo that was the reason why in 1561 the Indias Council decided to condemn him at Capital Punishment.
