dc.description.abstractEn el presente trabajo se expondrán algunos de los enfoques más sobresalientes que existen en la filosofía política contemporánea sobre la desobediencia civil, desde la perspectiva de autores tan diversos como Jurgën Habbermas, Ronald Dworkin y Jorge F. Malem. Se analizarán las razones por las cuales no podemos aceptar el postulado según el cual, un ciudadano tiene la obligación de obedecer la ley en todo momento sin importar las circunstancias, demostrando que en algunos casos específicos, las leyes o normas del estado no son compatibles con los principios de justicia que deben regir una sociedad verdaderamente democrática. Así pues, en la medida en que los desobedientes civiles no siguen tales leyes o las violan, aunque sus actos pueden estar al margen de la ley, no son necesariamente injustos o inmorales como se cree, por el contrario, dichos actos aunque sean ilegales en principio, apuntan a reestablecer la justicia que ha sido violada por el estado, cuando intenta hacer cumplir normas que violan o recortan injustificadamente algún derecho fundamental. De este modo quedará demostrado que la desobediencia civil, no solo es compatible con el sistema democrático, sino que es una herramienta de sociedad civil que puede ser utilizada para corregir los errores y posibles abusos de poder de las mayorías gobernantes.
dc.description.abstractenglishIn the present work will expose some of the approaches more excellent than they exist in the contemporary political philosophy on the civil disobedience, since the perspective of authors as diverse as Jurgën Habbermas, Ronald Dworkin and Jorge F. Malem. The reasons will be analyzed by which we cannot accept the advanced according to which, a citizen has the obligation to obey the law in every moment without importing the circumstances, showing that in some specific cases, the laws or norms of the state are not compatible with the principles of justice that should govern a truly democratic company. Thus therefore, in the measure in which the disobedient civilians do not continue such laws or they violate them, although their acts can be al margin of the law, they are not necessarily unjust or immoral as is believed, on the contrary, you said acts although be illegal in principle, they aim at reestablecer the justice that has been violated for the state, when tries to cause to comply norms whose violation of some fundamental right is flagrant Or at least very controversial. In this way will remain shown that the not alone, civil disobedience is compatible with the democratic system, but is a tool of the civil company that can be utilized to correct the errors and possible abuses to be able of the majorities rulers.
