dc.description.abstractEste estudio de caso del proceso de reparación colectiva del colegio Rosario de Charalá tiene como objetivo comprender a partir del entendimiento del contexto del conflicto armado colombiano y el paradigma legal de los mecanismos de reparación colectiva, implementados en casos de violaciones sistemáticas a los derechos humanos, la pertinencia de los mecanismos empleados por el Estado Colombiano para verdaderamente reparar colectivamente a las víctimas en el caso concreto, principalmente desde el ámbito educativo, entendiendo las particularidades y características del grupo poblacional afectado, que lo hacen especialmente vulnerable, en aras de establecer el grado de asertividad de las mismas en un contexto complejo como el colombiano, en el que la continuación del conflicto armado, la corrupción y la impunidad, permean el accionar del Estado y condicionan el nivel de eficacia y perdurabilidad de las medidas de reparación colectiva empleadas. El estudio analiza, además, la jurisprudencia relevante reciente a nivel macro, meso y micro de las Cortes que establecen dentro de sus sentencias este tipo de reparaciones, en procura de comprender la postura de las altas cortes colombianas y, con ello, establecer cuánto de estas se ve reflejado efectivamente en lo ejecutado y si las mismas materializan los derechos a la reparación integral y a la no repetición, tanto a nivel teórico y práctico, indagando cómo es percibido tanto el proceso como los resultados por parte de la comunidad afectada y, por último, teniendo en cuenta la suma de las afectaciones individuales que trascienden lo colectivo, como lo colectivo en sí, para determinar finalmente si las medidas resultan proporcionadas en razón de la efectiva estimación del daño, puesto que se advierte que en este tipo de casos el nivel de validez de las medidas depende en gran medida de su eficacia, de si las mismas dan lugar a transformaciones reales de las condiciones sociales y, en menor medida particular, de la población afectada.
dc.description.abstractenglishThis case study of the collective repair process of the Rosario de Charalá school aims to understand from the understanding of the context of the Colombian armed conflict and the legal paradigm of collective redress mechanisms, implemented in cases of systematic human rights violations, the relevance of the mechanisms employed by the Colombian State to truly collectively redress victims in the particular case, mainly from the educational field, understanding the particularities and characteristics of the affected population group, which make it particularly vulnerable, in order to establish the degree of assertiveness of them in acomplex context such as Colombia, in which the continuation of the armed conflict, the corruption and impunity, permeate the actions of the State and condition the level of effectiveness and durability of the collective redress measures employed. The study also analyses the recent relevant case law at the macro, meso and micro level of the Courts that establish within their judgments such reparations, in order to understand the position of the high Colombian courts and thereby establish how much these are effectively reflected in what is implemented and whether they materialize the rights to comprehensive reparation and non-repetition, both theoretically and practically, investigating how both the process is perceived and the results by the community and, finally, taking into account the sum of the individual affectations that go beyond the collective, such as the collective itself, to determine whether the measures are proportionate by reason of the actual estimate of injury, since the damage is actually it warns that in such cases the level of validity of the measures depends to a large extent on their effectiveness, whether they give rise to real transformations of social conditions and, to a lesser extent, the population concerned.
