dc.description.abstractEl nuevo Procedimiento verbal de responsabilidad fiscal creado por la Ley 1474 de 2011, es una herramienta introducida por el legislador en aras de fortalecer la lucha contra la corrupción imperante en nuestro país; no obstante su propósito, la norma en su novedad se quedó corta en el abordaje de circunstancias del mismo, dejando al operador fiscal en una situación peligrosa de latente violación al debido proceso. Por lo anterior, la Contraloría municipal de Bucaramanga en el imperativo de dar aplicación a dicho trámite, se ve inmersa en la necesidad de documentar el procedimiento para aplicarlo a cabalidad, protegiendo las garantías constitucionales del investigado y el trámite procesal, pero sin descuidar los fines del mismo: eficacia y celeridad. De esta manera mediante el desarrollo de la práctica jurídico social, se emprendió un proceso de búsqueda de información, de análisis de los sistemas jurídicos aplicables analógicamente al procedimiento como lo es el administrativo, el penal y el disciplinario, y de seguimiento a las audiencias orales surtidas por la Contraloría General de la República, y la Contraloría Departamental de Santander, a efectos de realizar un manual del procedimiento que guie minuciosamente a los servidores de la Contraloría Municipal de Bucaramanga en su aplicación.
dc.description.abstractenglishThe new Verbal procedure of Fiscal Responsibility created by the Act 1474 of 2011, is a tool introduced by the legislator in order to strengthen the fight against corruption that there is in our country; however this purpose, the law in its novelty was short in addressing some circumstances, leaving the fiscal operator in a difficult situation of latent violation of due process. By the above, process, arose the need of study the process to apply adequately, protecting constitutional guarantees of the investigated, and the procedural process, without neglecting the purposes thereof: efficiency and celerity, and other good values that it were the objective of their borned Then, through of the social legal practice, I started a job in the Contraloria municipal of Bucaramanga, of search more information, and analysis of other applicables legal systems in the verbal process of fiscal responsibility, as the administrative, civil, criminal and disciplinary, and the monitoring of the audiences conducted by the General and Deparamental`s Contralorias, and the General of the nation Contraloria, to finally make a manual procedure to guide the application by the Bucaramanga`s Contraloria servers, and then have a good tool to combat the damage to the Estate.
