dc.description.abstract	La práctica jurídico social a exponer en el presente trabajo de grado se desarrolló en el marco del convenio específico de cooperación celebrado entre la Universidad Industrial de Santander y la Corporación Justicia y Libertad. A grandes rasgos, la Corporación Justicia y Libertad está conformada por un grupo de profesionales en ciencias sociales y jurídicas que acompañan, a través de sus saberes, diferentes procesos de desarrollo comunitario y sindical en pro de la promoción de los derechos humanos y/o derechos humanos laborales. Ahora bien, el principal objeto del trabajo de grado fue la formación a través de la experiencia práctica sobre el ejercicio y reivindicación de los derechos laborales colectivos relacionados a la libertad sindical; esto en especial atención al proceso de negociación colectiva y huelga desarrollado por el Sindicato de Trabajadores de la Palma de Palmosan (Sintrapalmosan), el cual duró aproximadamente 6 meses. En este sentido, como miembro pasante de la institución mencionada se participó en la asistencia y proyección de acciones jurídicas tales como: asesorías, derechos de petición, acciones de tutela, demandas y contestaciones de demandas; lo anterior dentro de procesos organizativos sindicales como los de Sintraelecol seccional Bucaramanga, Sintrainagro seccional Minas y, por supuesto, Sintrapalmosan. Asimismo, para efectos del presente escrito, se elaboró una suerte de aproximación teórica y conceptual a los elementos y derechos que surgen de la libertad sindical; destacando lo que ello implica para el Estado colombiano en calidad de garante de aquellos derechos a la luz de la suscripción de diferentes tratados de derechos humanos y su calidad de miembro de la Organización Internacional del Trabajo.
dc.description.abstractenglish	The socio-legal practice presented in this thesis was conducted under the specific cooperation agreement between the Universidad Industrial de Santander and the Corporación Justicia y Libertad. In broad terms, the Corporación Justicia y Libertad comprises a group of professionals in social and legal sciences who, through their expertise, support various community and trade union development processes in pursuit of the promotion of human rights and/or labor human rights. Therefore, the main objective of this thesis was practical learning about the exercise and assertion of collective labor rights related to trade union freedom. This is particularly focused on the collective negotiation and strike process carried out by the Workers' Union of the Palma de Palmosan (Sintrapalmosan), which lasted approximately 6 months. In that sense, as a participant intern of the aforementioned institution, involvement included assistance and implementation of legal actions such as consultations, rights of petitions, legal protections (Acciones de tutela), lawsuits, and responses to lawsuits. These actions were undertaken within trade union organizing processes like those of Sintraelecol's Bucaramanga branch office, Sintrainagro's Minas branch office, and, of course, Sintrapalmosan. Furthermore, a theoretical and conceptual approach was developed for the purpose of this writing, aiming to explore the elements and rights that arise from trade union freedom, and the implications for the Colombian State as the guarantor of those rights, in light of the endorsement of various human rights treaties and its status as a member of the International Labour Organization.
