dc.description.abstractLa investigación plantea hacer una crítica a la Teoría Pura del Derecho de Hans Kelsen, texto que ha sido el referente científico en el mundo del Derecho. Se contrastará dicha teoría con los aportes críticos de Marx y Engels. Primero. haciendo una crítica a la metodología pura, luego a la norma fundamental, y finalmente haciendo un aporte al estudio sobre las determinaciones del Estado de Derecho. La crítica en este trabajo pretende avanzar en el conocimiento de lo real como una forma concreta de la acción política, el conocimiento como el momento en que la acción se organiza para alcanzar su máxima potencialidad transformadora de la vida social. Encontrar las determinaciones materiales del Derecho y su especificidad frente a otras formas sociales para aportar a una visión científica sobre el mismo. Con el fin de aportar a una universidad crítica, que propende por la transformación social y el impacto real en la vida de las comunidades, este trabajo pretende generar un enfoque novedoso y materialista al estudio del derecho para producir conocimientos que permitan un cambio real en la sociedad actual, conocimiento que permita a la comunidad adquirir conciencia de su posición frente al derecho y de su acción transformadora ante el mismo.
dc.description.abstractenglishThe research proposes to make a critique of Hans Kelsen’s Pure Theory of Law, a text that has been the scientific reference in the world of Law. This theory will be contrasted with the critical contributions of Marx and Engels. First, by making a critique of the pure methodology, then of the fundamental norm, and finally by making a contribution to the study of the determinations of the Rule of Law. The critique in this work aims to advance the knowledge of the real as a concrete form of political action, knowledge as the moment in which action is organized to achieve its maximum transformative potential of social life. To find the material determinations of Law and its specificity in relation to other social forms, to contribute to a scientific vision of it. In order to contribute to a critical university, which strives for social transformation and real impact on the life of the communities, this work intends to generate a novel and materialist approach to the study of law, to produce knowledge that allows a real change in the current society, knowledge that allows the community to acquire awareness of its position in relation to the law and of its transformative action towards it.
