dc.description.abstract	El presente trabajo de investigación se compone de cuatro informes mensuales que fueron presentados durante el desarrollo de la práctica jurídico empresarial dentro de la firma RUGELES ABOGADOS & ASOCIADOS, la cual se abordó en el periodo que comprende los meses de agosto del año 2022 a enero del año 2023. La labor desempeñada correspondió al poyo jurídico brindado en el área de litigios de naturaleza ejecutiva, y la cual permitió desarrollar de forma enriquecedora la materialización e importancia de las medidas cautelares, específicamente la denominada “remanente judicial”, con el fin de evitar vulneración mayor del derecho – incumplimiento de una obligación - que ocasionó el acudir a la instancia judicial. En consecuencia, se adelantaron en primer lugar, aspectos generales de los procesos ejecutivos y de su materialización mediante medidas cautelares, para así poder abordar actividades de análisis y observación a través de la revisión y apoyo jurídico brindado en procesos ejecutivos que se encontraran activos. Seguido de esto, se adelantaron actos que permitirían la recolección de datos e información para con la medida objeto de investigación. Y, por consiguiente, poder establecer las actuaciones que podría desarrollar quien tiene la titularidad del remanente judicial, dentro del proceso ejecutivo del cual no actúa como ejecutante principal, así como su importancia y finalidad.
dc.description.abstractenglish	This research work consists of four monthly reports that were presented during the development of the business legal practice within the firm RUGELES ABOGADOS & ASOCIADOS, this was carried out between the months of August of the year 2022 to January of the year 2023. The work carried out corresponded to the legal support provided in the area of litigation of an executive nature, and which allowed to develop in an enriching way the materialization and importance of the precautionary measures, specifically the so-called "judicial remnant", in order to avoid further violation of the right - breach of an obligation - that led to going to court. Consequently, in the first place, general aspects of the executive processes and their materialization through precautionary measures were advanced, in order to be able to address analysis and observation activities through the review and legal support provided in active executive processes. Following this, acts were carried out that would allow the collection of data and information for the measure under investigation. And, consequently, to be able to establish the actions that could be carried out by whoever owns the judicial remainder, within the executive process of which he does not act as the main executor, as well as their importance and purpose.
