dc.description.abstractEl texto reconstruye los inicios del paramilitarismo en Colombia y su transformación de grupos de Autodefensas en apartados organizados de poder vinculados al narcotráfico y su desmovilización en virtud del proceso de justicia transicional con la Ley 975 de 2005, denominada Ley de justicia y paz. Posteriormente, se elabora una caracterización conceptual de la figura de la extradición en Colombia a partir de los antecedentes jurisprudenciales y legales. Así mismo, se relaciona el derecho a la justicia, verdad y reparación, como principios básicos del proceso de Justicia y Paz; la política del estado sobre la extradición y el Derecho Internacional de los Derechos Humanos a la verdad y finaliza con la primacía entre la extradición y el derecho a la verdad. De otra parte, se analiza el fenómeno de la extradición en el contexto del proceso de Justicia y Paz concluyendo con la extradición de Salvatore Mancuso Gómez en pleno desarrollo del proceso de Justicia y Paz desde la óptica de las víctimas y las partes integrantes del proceso transicional, sobre las bases normativas, constitucionales y los pronunciamientos de la Corte Interamericana de Derechos Humanos, que reclaman el retorno de Mancuso a Colombia a cumplir con los compromisos adquiridos al interior del proceso de justicia transicional. Finalmente, se construye una reflexión sobre las implicaciones de la extradición de Salvatore Mancuso en lo relacionado con la garantía de los derechos a la verdad, la justicia, la reparación y las garantías de no repetición, concluyendo que dicho acto cercenó los derechos de las víctimas consagrados en el sistema de justicia transicional.
dc.description.abstractenglishThe text reconstructs the beginnings of paramilitarism in Colombia and its transformation from self-defense groups into organized sections of power linked to drug trafficking and their demobilization by virtue of the transitional justice process with Law 975 of 2005, called the Justice and Peace Law. Subsequently, a conceptual characterization of the figure of extradition in Colombia is elaborated from the jurisprudential and legal antecedents. Likewise, the right to justice, truth and reparation is related as basic principles of the Justice and Peace process; the state's policy on extradition and the International Law of Human Rights to the truth and ends with the primacy between extradition and the right to the truth. On the other hand, the phenomenon of extradition is analyzed in the context of the Justice and Peace process, concluding with the extradition of Salvatore Mancuso Gómez in full development of the Justice and Peace process from the perspective of the victims and the integral parts of the transitional process, on the normative and constitutional bases and the pronouncements of the Inter-American Court of Human Rights, which demand the return of Mancuso to Colombia to comply with the commitments acquired within the transitional justice process. Finally, a reflection is built on the implications of the extradition of Salvatore Mancuso in relation to the guarantee of the rights to truth, justice, reparation and guarantees of non-repetition, concluding that said act curtailed the rights of the victims. enshrined in the transitional justice system.
