dc.description.abstractLa presente investigación analiza si surge una responsabilidad extracontractual del Estado colombiano en el marco del estado de emergencia por COVID-19 con ocasión del hacinamiento en las Estaciones de Policía en el Área Metropolitana de Bucaramanga y dada la ineficacia de las medidas de salubridad adoptadas para evitar los contagios. Lo anterior, desde las siguientes consideraciones: la identificación de las obligaciones y responsabilidad del Estado colombiano frente al derecho a la integridad personal de personas privadas de la libertad. El estudio de las implicaciones del Estado de excepción declarado por la emergencia por COVID-19 en el derecho a la integridad personal de personas privadas de la libertad. Y, la exposición de las medidas adoptadas y su efectividad por parte de las entidades competentes y responsables en el marco del Estado de emergencia por COVID-19, 2020-2021, respecto del derecho a la integridad personal a las personas privadas de la libertad, en las Estaciones de Policía del Área Metropolitana de Bucaramanga.
dc.description.abstractenglishThe present investigation analyzes whether a non-contractual responsibility of the Colombian State arises within the framework of the state of emergency due to COVID-19 due to the overcrowding in the Police Stations in the Metropolitan Area of Bucaramanga and given the ineffectiveness of the health measures adopted to avoid the infections. The foregoing, from the identification of the obligations and responsibility of the Colombian State regarding the right to personal integrity of persons deprived of liberty; the study of the implications of the state of emergency declared by the COVID-19 emergency on the right to personal integrity of persons deprived of liberty; and the presentation of the measures adopted and their effectiveness by the competent and responsible entities within the framework of the State of emergency due to COVID-19, 2020-2021, regarding the right to personal integrity of persons deprived of their liberty, in the Police Stations of the Metropolitan Area of Bucaramanga; as specific goals.
