| dc.description.abstract | El objetivo principal de este trabajo es identificar y analizar las consecuencias que sobre las entidades territoriales de Santander ocasionan las reformas realizadas en el régimen de regalías petroleras en Colombia, contempladas en la Ley 756 de 2002. El trabajo consta de cinco capítulos. El primer capítulo expone los elementos teóricos propuestos por la teoría económica Neoinstitucionalista necesarios para interpretar el cambio en los derechos de propiedad que sobre las regalías petroleras tienen municipios y departamentos. El segundo capitulo presenta la evolución histórica del marco legal de las regalías petroleras en el país y se explica los principios y reglas establecidas por la Ley 141 de 1994, la cual fue la primera norma formal sobre la materia. El tercer capítulo hace una descripción del comportamiento de los ingresos por regalías petroleras en Santander y analiza su importancia para las finanzas territoriales y su contribución sectorial a los distintos componentes de la inversión social. El cuarto capítulo se presenta los argumentos expuestos por el gobierno para implementar las reformas, y se contrastan estos con los resultados a que han llegado varios estudios en materia de identificar los determinantes de la exploración y explotación petrolera en el país; además se explican todas las reformas introducidas por la Ley 756 de 2002. En el quinto capítulo se identifica los efectos directos de la nueva ley sobre los montos de las regalías petroleras asignadas a los municipios y departamento en Santander. Finalmente en el sexto y séptima capítulo, a partir de los hallazgos encontrados en el desarrollo del trabajo, se realizan unas conclusiones y recomendaciones en procura de que las entidades territoriales de Santander afronten los nuevos desafíos y desventajas socioeconómicas que se avecinan con la operación de la nueva ley de regalías petroleras. | |
| dc.description.abstractenglish | The principal aim of this work is to identify and to analyze the consequences that on the territorial entities of Santander cause the reforms realized in the regime of petroleum royalties in Colombia, contemplated in the Law 756 of 2002. The work consists of five chapters. The first chapter exposes the theoretical elements proposed by the economic theory necessary Neoinstitucionalista to interpret the change in the rights of property that on the petroleum royalties have municipalities and departments. The second chapter presents the historical evolution of the legal frame of the petroleum royalties in the country and explains to herself(itself) the principles and rules established by the Law 141 of 1994, which was the first formal norm on the matter. The third chapter does a description of the behavior of the income for petroleum royalties in Santander and analyzes his importance for the territorial finance and his sectorial contribution to the different components of the social investment. The fourth chapter appears the arguments exposed by the government to implement the reforms, and these are confirmed by the results to which several studies have come as for identifying the determinants of the exploration and petroleum exploitation in the country; besides explain to themselves all the reforms introduced by the Law 756 of 2002. In the fifth chapter there are identified the direct effects of the new law on the amounts of the petroleum royalties assigned to the municipalities and department in Santander. Finally in sixth and the seventh chapter, from the finds found in the development of the work, a few conclusions and recommendations are realized in tries gets of that the territorial entities of Santander confront the new challenges and socioeconomic disadvantages that they approach with the operation of the new law of petroleum royalties. | |
