dc.description.abstractLa Constitución Política de 1991 es innovadora en la idea de Seguridad Social Integral en Colombia al consagrarla como derecho constitucional. El Sistema de Riesgos Profesionales (SRP) hace parte de ese nuevo Sistema de Seguridad Social Integral que protege a los trabajadores de los riesgos profesionales (enfermedad profesional y accidente de trabajo). El SRP entrega a las Juntas Regionales de Calificación de Invalidez (JRCI) la función de establecer el origen como común o profesional de una enfermedad o accidente y establecer la perdida de capacidad laboral de un trabajador cuando hay controversias en esas calificaciones entre los actores del SRP. Este estudio permite analizar el comportamiento los de Riesgos Profesionales en Santander desde la (JRCI) en lo relacionado con las condiciones de trabajo y prestaciones económicas cuando se sufre un accidente de trabajo o enfermedad profesional, la edad, deficiencias, actividad laboral y sexo de las personas, También se analiza los fallos de constitucionalidad de la Corte Constitucional que muestran serias falla en el SRP. Los resultados muestran que la JRCI de Santander requiere cada vez mayor especialización por la gran cantidad de casos del SRP; las controversias mayores son sobre pérdida de capacidad laboral que sobre el origen; han salido mejor libradas las Administradoras de Riesgos Profesionales (ARP) porque la mayoría de dictámenes califican el origen como común y, el actual concepto de la Comunidad Andina de Naciones que se maneja en Colombia es mas restringido que el anterior, declarado inconstitucional por la Corte. Se hace necesaria una ley que reglamente el SRP para los trabajadores independientes, que consagre el concepto de accidente de trabajo de manera amplia, incluso; consagrando el accidente de trabajo en ejercicio de funciones sindicales.
dc.description.abstractenglishThe Political Constitution of 1991 is innovative in the idea of Integral National Health Service in Colombia on having dedicated its as constitutional law. The System of Professional Risks (SRP) does part (report) of this new System of Integral National Health Service that protects the workers of the professional risks (occupational disease and accident of work). The SRP delivers to the Regional Board of Qualification of Invality (JRCI) the function to establish the origin as commonly or professional of a disease or accident and to establish the loss of labour capacity of a worker when there are controversies in these qualifications between the actors of the SRP. This study allows to analyze the behavior those of Professional Risks in Santander from the (JRCI) in the related thing to the conditions of work and economic services when there has be an accident of work or occupational disease, the age, deficiencies, labour activity and sex of the persons, also, analyzes the judgements of constitutionality of the Constitutional Court that prove to be serious fails in the SRP. The results shows that the JRCI of Santander needs every time major specialization for the great quantity of cases of the SRP; the major controversies are on loss of labour capacity that on the origin; there have worked out better freed the Administratrices of Professional Risks (ARP) because the majority of opinions qualify the origin as commonly and, the current concept of the Andean Community of Nations that one handles in Colombia is more restricted that previous, declared unconstitutionally for the Court. There becomes necessary a law that the SRP regulates for the independent workers, that it dedicates the concept of accident of work, enclosed of wide way; even, dedicating the accident of work in exercise of syndical functions.
