dc.description.abstractEl presente trabajo analiza la efectividad de las sentencias proferidas durante los años 2014 y 2016 en los Juzgados Civiles Especializados en Restitución de Tierras de la ciudad de Cúcuta y Bucaramanga; en esta investigación se entiende la efectividad de las sentencias como el nivel de cumplimiento de todas las órdenes emitidas por el juez, incluyendo las de restitución material y jurídica, y las demás relacionadas con la reparación integral. Se realiza además una mirada a los instrumentos internacionales de protección de los Derechos Humanos y de las normas internas, la jurisprudencia de las Cortes desarrolladas en respuesta a la problemática nacional. Además, se desarrolla una investigación de tipo documental a cerca de los contextos de violencia que han azotado a estos dos departamentos observando cifras estadísticas en el Registro Único de Victimas RUV en las cuales se visibiliza el enorme problema del Desplazamiento Forzado, resultado de la violencia y del conflicto armado interno por más de cincuenta años. En consecuencia, el problema jurídico que abordará la investigación, se describe en los siguientes términos: ¿ es la efectividad de las sentencias proferidas por los juzgados de Restitución de Tierras de Cúcuta y Bucaramanga en los años 2014-2016 en materia de restitución y reparación integral?
dc.description.abstractenglishThe present work analyzes the effectiveness of the sentences pronounced during the years 2014 and 2016 in the Specialized Civil Courts in Restitution of Lands of the city of Cucuta and Bucaramanga. In this investigation the effectiveness of the sentences is understood as the level of compliance with all the orders issued by the judge, including those of material and legal restitution, and the rest related to the integral reparation. It also takes a look at the international instruments for the protection of Human Rights and internal rules, and the jurisprudence of the Courts developed in response to the national problem. In addition, documentary research is carried out on the contexts of violence that has plagued these two departments, observing statistical figures in the Unique Register of Victims RUV in which the enormous problem of Forced Displacement is made visible, as a result from violence produced by the internal armed conflict that the country has lived for more than fifty years. Consequently, the legal problem that the investigation will address is described in the following terms: What is the effectiveness of the judgments delivered by the Land Restitution Courts of Cucuta and Bucaramanga in the years 2014-2016 regarding restitution and integral reparation?
