dc.description.abstractEl presente trabajo de investigación analiza el cambio en el régimen disciplinario en Colombia sobre la Sentencia de la Corte Interamericana de Derechos Humanos en el caso Petro Urrego vs Colombia que da inicio a un nuevo paradigma y estableció la importancia de la división de roles como forma de aplicación del principio de imparcialidad objetiva para proteger las garantías procesales del disciplinado. Sin embargo, la actuación disciplinaria contra abogados no cuenta con dicha salvaguarda debido al esquema procesal vigente en la Ley 1123 de 2007, por lo que se plantea la necesidad de aplicar el principio de imparcialidad objetiva en este tipo de actuaciones para proteger el derecho fundamental del debido proceso de los abogados.
dc.description.abstractenglishThe present research paper analyzes the change in the disciplinary regime in Colombia regarding the Inter-American Court of Human Rights' Judgment in the case of Petro Urrego vs. Colombia, which marks the beginning of a new paradigm and establishes the importance of the division of roles as a means of applying the principle of objective impartiality to protect the procedural guarantees of the disciplined individual. However, disciplinary proceedings against lawyers do not have this safeguard due to the current procedural framework in Law 1123 of 2007. Therefore, it is proposed that the principle of objective impartiality should be applied in such proceedings to protect the fundamental right to due process of lawyers.
