dc.description.abstractLas mujeres privadas de la libertad deben afrontar, además de un reproche social y familiar por la presunta o efectiva vulneración de la ley penal, el juzgamiento y ejecución de la pena por parte de apoderados y operadores judiciales que desconocen la perspectiva de género, haciendo más gravosa su situación al omitir la aplicación conjunta y sistemática de aquellas normas internas e interamericanas que regulan la defensa técnica, la no discriminación contra la mujer y las acciones afirmativas que han de tomarse en su favor para garantizar sus derechos. En el presente trabajo se aborda inicialmente, las consideraciones y aportes hechos respecto a la defensa técnica, desde el Sistema Interamericano de Derechos Humanos y el derecho interno, seguidamente se hace un análisis conceptual de la perspectiva de género y la situación de las mujeres privadas de libertad en Colombia y se culmina con una compilación del estándar que debe cumplirse para que la defensa de las mujeres sea verdaderamente técnica en clave de género.
dc.description.abstractenglishWomen deprived of liberty must face, in addition to a social and family reproach for the alleged or effective violation of criminal law, the trial and execution of the sentence by attorneys and judicial operators who ignore the gender perspective. That fact makes their situation more dangerous by omitting the joint and systematic application of those internal and inter-American norms that regulate the technical defense, non-discrimination against women and, affirmative actions to be taken in their favor to guarantee their rights. This paper initially addresses the considerations and contributions made concerning technical defense from the Inter-American Human Rights System and domestic law, followed by a conceptual analysis of the gender perspective and the situation of women deprived of liberty in Colombia. Finally, it concludes with a compilation of the standards that must be necessary for the defense of women to be truly technical in a gender perspective.
