dc.description.abstractLa presente investigación parte una revisión literaria en torno al bienestar animal, especialmente el bienestar animal en Colombia, en donde se estudia la fase de implementación y avance de la Ley 2054 de 2020, en los municipios del departamento de Santander, Colombia. Para ello se usa una metodología de investigación mixta junto al análisis de las respuestas de un derecho de petición presentado a los 87 municipios del departamento permitiendo exponer el panorama regional en términos de bienestar animal. Con ello se pudo establecer el avance de la implementación de la Ley en los territorios a Julio de 2021. Lo anterior con el fin de proponer mecanismos y herramientas que ayuden a mejorar la situación de bienestar animal por medio de la implementación de la Ley por medio del planteamiento de una lista de comprobación del cumplimiento de la ley, una acción judicial que puede impulsar la implementación, y la descripción de los personeros municipales como funcionarios con las facultades para realizar acciones en busca de garantizar los derechos de los animales como sujetos de especial protección.
dc.description.abstractenglishThis research is based on a literary review of animal welfare, especially animal welfare in Colombia, where the phase of implementation and progress of Law 2054 of 2020 is studied in the municipalities of the department of Santander, Colombia. For this, a mixed research methodology is used together with the analysis of the responses of a right of a petition presented to the 87 municipalities of the department, allowing it to expose the regional panorama in terms of animal welfare. With this, it was possible to establish the progress of the implementation of the law in the territories as of July 2021. The above is to propose mechanisms and tools that help improve the situation of animal welfare through the implementation of the law through the approach of a checklist of compliance with the law, a legal action that can promote implementation, and the description of municipal ombudsmen as officials with the power to carry out actions in search of guaranteeing the rights of animals as subjects of special protection.
