dc.description.abstractEn Colombia el modelo político-económico ha promovido la industria extractiva como un motor fundamental para la economía nacional, por lo que ha impulsado numerosos proyectos de exploración, explotación, extracción y comercialización de recursos naturales como lo son los hidrocarburos. Para ello, cuenta con diferentes reglamentaciones y normativas que, pese a este grueso jurídico, se ha demostrado que en la práctica no se ha garantizado de manera efectiva y real el derecho a la participación de la sociedad en la toma de decisiones respecto al destino de sus territorios y el uso de sus recursos; en este contexto se viabilizó el uso de la técnica de Fracturamiento Hidráulico Multietapa con Perforación Horizontal en Yacimientos No Convencionales de Hidrocarburos, más conocida como fracking, lo cual generó en el país una serie de debates y polémicas en diferentes escalas. De esta manera, en esta investigación se desarrolla un diagnóstico social, analizado desde la Teoría Critica de los Derechos Humanos y la Ecología Política, el cual describe la dinámica de participación y defensa de los Derechos Humanos que tuvieron las organizaciones y grupos sociales que resistieron al fracking en el marco del primer Proyecto Piloto de Investigación Integral de la técnica, denominado “KALÉ” ubicado en Puerto Wilches, Santander, durante los años 2020 y 2021. Este diagnóstico refiere el desarrollo histórico de los actores sociales analizados, demuestra sus experiencias de participación social que a su vez determina las herramientas como mecanismos utilizados en su actuar, y analiza los alcances y limitaciones que presentaron en su oposición a la técnica lo largo del periodo de tiempo delimitado; lo que da cuenta del abismo existente entre la normatividad nacional e internacional que regula tanto la participación social, como otros derechos humanos y su aplicabilidad en el territorio donde se ejecutó parcialmente el primer proyecto piloto de investigación integral de fracking del país.
dc.description.abstractenglishIn Colombia, the political-economic model has promoted the extractive industry as a fundamental engine for the national economy, for which it has promoted numerous projects of exploration, exploitation, extraction and commercialization of natural resources such as hydrocarbons, for which it has stablish different regulations and norms; Despite this legal framework, it has been demonstrated that in practice, the right to participation of society in the decisions regarding the destiny of its territories and the use of its resources has not been guaranteed in an effective and real way; in this context the use of the multi-stage hydraulic fracturing technique with horizontal drilling in non-conventional hydrocarbon fields, better known as fracking, was made viable. Which in our country, generated a series of debates and controversies at different scales. In this sense, this research develops a social diagnosis from the critical theory of human rights and political ecology. Which describes, the dynamics of participation and defense of human rights, that the organizations and social groups who oppose fracking had in the framework of the first pilot project of integral research of the technique, called "KALÉ", located in Puerto Wilches Santander, during the years 2020 and 2021. This diagnosis, refers to the historical development of analyzed social actors, demonstrating their experiences of social participation, determining the tools and mechanisms used in their actions and analyzing the scope and limitations they presented, in their opposition to the technique throughout a delimited period of time; this accounts for the existing gap between the national and international regulations regarding both social participation and other human rights, and its applicability in the territory where the first pilot project of integral research of fracking was partially executed in the country.
