dc.description.abstractEl presente trabajo de grado de la maestría de intervención social de la Universidad Industrial de Santander, abarca dos momentos; el primero es la descripción del análisis situacional realizado con los actores restaurativos del centro zonal Resurgir del ICBF especializado en Responsabilidad Penal para Adolescentes de Bucaramanga SRPA- el cual se orientó a la comprensión de las dinámicas que emergen entorno a la aplicación de los procesos de justicia restaurativa como el principio de oportunidad en el SRPA- y otras prácticas, en el sistema de justicia juvenil en Colombia. Este estudio que se ubicó en el horizonte de la investigación cualitativa, bajo un enfoque fenomenológico, con propósito exploratorio y que tomó la metodología de estudio caso con tipología de un caso o unidad de análisis, además permitió realizar a través de sus resultados la construcción de la propuesta de aplicación denominadacomuniquémonos, un principio, una oportunidad- representando el segundo momento. Concretamente busca romper las barreras y fortalecer las posibilidades de aplicar el principio de oportunidad en la modalidad de suspensión del procedimiento a prueba, en el marco de la justicia restaurativa en el Sistema de Responsabilidad Penal para Adolescentes de Bucaramanga, teniendo en cuenta las características identificadas. Tanto el análisis situacional, como la propuesta de aplicación se sustentaron teórica, conceptual, normativa y metodológicamente. Además, en el intento de comprender lo investigado se utilizaron herramientas como la entrevista semiestructurada y la encuesta por cuestionario, que aportaron datos relevantes que posteriormente fueron interpretados en base a las proposiciones teóricas producto de la muestra teórica previamente identificada. Para el caso de la propuesta de aplicación se brindaron estrategias con relación a las particularidades y características identificadas en él análisis, donde se sugiere la utilización de las mismas a fin de contribuir investigativa e intervinientemente, en el logro de los resultados
dc.description.abstractenglishThis degree thesis corresponds to the Masters of Social Intervention at Universidad Industrial de Santander. It comprehends two stages. The first one is the description of the situational analysis carried out with the restorative actors of the zonal center specialized in criminal responsibility for adolescents of Bucaramanga (SRPA in Spanish). The analysis was oriented to the understanding of the dynamics that emerge around the application of the processes of restorative justice like the principle of opportunity in the SRPA- and other practices in the juvenile justice system of Colombia. This study, which was located on the field of qualitative research, under a phenomenological approach with exploratory purpose, took the case study methodology with a typology of a case or unit of analysis. Furthermore, it allowed to . Specifically, it seeks to break down the barriers and strengthen the possibilities of applying the principle of opportunity in the modality of suspension of the trial procedure, within the framework of restorative justice in the Criminal Responsibility System for Adolescents of Bucaramanga, taking into account the identified characteristics. Both, the situational analysis and the intervention proposal, were supported theoretically, conceptually, normatively and methodologically. In addition, in the attempt to understand what was investigated, tools such as the semistructured interview and the questionnaire survey were used. They provided relevant data that were later interpreted based on the theoretical propositions that were product of the previously identified theoretical sample. In the case of the application proposal, strategies were provided in relation to the particularities and characteristics identified in the analysis, where the use of them is suggested to contribute by investigating and interacting so as to achieve the results
