dc.description.abstractCon la Constitución de 1991, la educación en Colombia tiene una doble connotación, como derecho de la persona y como servicio público originado en su función social; así se convierte en una obligación que se materializa por medio del docente, como la persona encargada de impartir conocimientos y quien tiene derecho a recibir las herramientas para poder continuar con su proceso de actualización y mejoramiento continuo, con el fin de alcanzar una formación integral que le permita cumplir con su labor bajo el principio de libertad de cátedra. Por lo anterior, la Universidad Industrial de Santander a través de Acuerdos del Consejo Superior ha reglamentado las situaciones administrativas de Comisión de Estudios, Estancia Posdoctoral y Año Sabático propiciando la excelencia en el ejercicio de la función docente. Es deber de la Universidad informar a los profesores en forma completa de las posibilidades de formación que les brinda la Institución. Este trabajo de grado en modalidad de práctica jurídico social, fue desarrollado al interior de la Universidad Industrial de Santander donde se adquirieron las competencias necesarias para elaborar una GUÍA dirigida a los funcionarios y docentes planta con el objetivo de facilitar la interpretación de los derechos y obligaciones que asumen tanto la institución como el docente en las situaciones administrativas enunciadas conforme a los procedimientos contemplados en los diversos Acuerdos vigentes. *
dc.description.abstractenglishWith the Constitution of 1991, the education in Colombia takes a double connotation, one, as a right of the person and as public service originated in his social function, turning into an obligation that materializes by means of the teacher, as the person entrusted to give knowledge and who has right to receive the tools to be able to continue with his process of update to make concrete the integral formation. For this motive, the Industrial University of Santander by means of Agreements of the Top Advice regulates the administrative situations of Commission of Studies, Postdoctoral Stay and Sabbatical Year propitiating the excellence in the exercise of the educational function, being the duty of the University to inform the teachers in complete form which are the possibilities of formation that offers to them the Institution. This work of degree is realized in the modality of social legal practice developed within the Industrial University of Santander, where the necessary competences were acquired to prepare a GUIDE aimed at the officials and teachers with the aim of facilitating the interpretation of rights and obligations in accordance with the procedures contemplated in various agreements in force and continuos improvement in order to achieve comprehensive education that allows to fulfill his work under the principle of freedom of chair. *
